This case is a challenge to Idaho state law, which makes it a felony to terminate a pregnancy. On January 14, 2025, St. Luke's Health System ("St. Luke's"), an Idaho-based health system which operates hospitals across the state, brought suit against the Attorney General of the State of Idaho, in U.S. District Court for the District of Idaho.

St. Luke's sued to challenge a law that Idaho passed in 2020 which created an almost-absolute ban on abortion, except in narrow circumstances.

To receive federal Medicare funds, hospital systems like St. Luke's, which are certified Medicaid providers, are required to provide necessary stabilizing treatment under the Emergency Medical Treatment and Labor Act (EMTALA), 42 U.S.C. § 1395dd. The Idaho law, codified at Idaho Code §18-622, made it a felony to terminate pregnancy in most instances, and made it a criminal offense for medical providers to provide stabilizing treatment. Before Idaho Code §18-622 went into effect, a court had preliminarily enjoined the law to the extent that it conflicted with EMTALA, in United States v. Idaho, 623 F. Supp. 3d 1096 (D. Idaho 2022). In appeal, defendants in Idaho succeeded in obtaining a stay of the preliminary injunction on two occasions, once as the Ninth Circuit decided whether to grant rehearing en blanc and once as the U.S. Supreme Court decided whether to grant cert, which it ultimately decided against. The procedural posture of Idaho at the time of the suit here was in statis: The Ninth Circuit heard arguments on appeal of the preliminary injunction, but had not yet issued a decision.

St. Luke's set forth in its complaint that Idaho Code §18-622 would prevent it and similarly-situated hospital systems from providing necessary medical care, in direct violation of the EMTALA.

St. Luke's argued that if the injunction were lifted, it would again result in its  being unable to comply with EMTALA. In their complaint, plaintiff St. Luke's to the history of the law: On the two instances when that injunction was stayed, plaintiff argued that both times, the Idaho law impeded plaintiff’s ability to properly treat patients, generally requiring the hospital to transfer certain patients out of state to receive necessary medical treatment. 

St. Luke's set forth that EMTALA, as federal law, preempts Idaho law: Therefore, plaintiff sued under the Supremacy Clause in the U.S. Constitution, seeking declaratory and injunctive action to declare Idaho’s law invalid and to enjoin the Idaho law to the extent it conflicts with EMTALA.

On January 14, 2025, St. Luke's filed a motion for preliminary injunction to prohibit enforcement of Idaho Code §18-622. In that motion, St. Luke's requested that the court also consider as part of the record the declarations that had been filed in United States v. Idaho in support of the motion for preliminary injunction there.

St. Luke's also filed a motion to consolidate, requesting that the court consolidate this matter with United States v. Idaho, which involved a challenge to the same Idaho law.

On February 6, the Attorney General filed a consolidated motion to dismiss for lack of jurisdiction and opposition to the preliminary injunction. Then, on March 4, St. Luke’s filed a motion for a temporary restraining order, which the court granted on the same day. The next day, the Attorney General motioned to modify the temporary restraining order. 

That same day, March 5, the court held a hearing on  the motions to dismiss, for preliminary injunction, and to modify the temporary restraining order. There, the court also deemed the motion to consolidate as moot.

Judge B. Lynn Winmill denied the Attorney General’s motion to dismiss on March 20. As well, he granted in part and denied in part the motion for a preliminary injunction and motion to modify the temporary restraining order, entering a  preliminary injunction that enjoined the Attorney General and his officers, employees and agents from enforcing Idaho Code §18-622 against St. Luke’s or its medical providers as applied to EMTALA-required medical care. 

In his reasoning, Judge Winmill found that St. Luke’s had standing, that the matter was fit for a judicial decision, and that sovereign immunity did not prevent the Attorney General from being sued here. He also found that St Luke’s had established it would likely succeed on the merits as there was a series of cases where it would be impossible to comply with EMTALA and Idaho Code §18-622.

As of May 2, 2025, the case is ongoing.
