(This is a temporary summary, while we research the case.) In this case, filed on February 3, 2025, in the U.S. District Court for the District of Columbia, a group of nonprofit immigrant advocacy organizations challenged the Trump Administration's decision to prohibit non-citizens from invoking the asylum provisions of the Immigration and Nationality Act, thereby causing noncitizens seeking asylum to be deported without adjudication of their claims for protection. The complaint alleged that the decision, which was apparently made pursuant to Proclamation 10888, titled “Guaranteeing the States Protection Against Invasion,” violated the Immigration and Nationality Act, the Foreign Affairs Reform and Restructuring Act, the Trafficking Victims Protection Reauthorization Act, the Administrative Procedure Act, and separation of powers.
The plaintiffs are represented by the ACLU and several other organizations, and by the law firm Jenner & Block. The case is ongoing.
