This is a challenge to the Office of Personnel Management’s (OPM) “Fork in the Road” email on January 28, 2025, which was sent to nearly all federal employees and announced a "deferred resignation" program. On January 28, 2025, OPM sent an email entitled “Fork in the Road” to nearly all federal career employees. The email announced a purported "deferred resignation" program, offering continued pay and benefits to federal employees through September 2025 who resigned by midnight February 6, 2025. The email also stated, "the majority of federal agencies are likely to be downsized through restructurings, realignments, and reductions in force," and OPM "cannot give you full assurance regarding the certainty of your position or agency."

On February 4, 2025, the plaintiffs--four labor organizations representing civilian federal employees--filed this complaint against OPM and its Director. OPM is the human resources agency and personnel policy manager for the federal government. The plaintiffs are represented by Murphy Anderson PLLC, Democracy Forward Foundation, and their own in-house counsel. The lawsuit was filed in the U.S. District Court for the District of Massachusetts. It was assigned to District Judge George A. O’Toole, Jr.

In the complaint, the plaintiffs argued that OPM offered no basis for its authority to adopt this program, and OPM purported to guarantee funds that Congress has not appropriated, in violation of the Antideficiency Act and the Administrative Procedure Act. They also contended that the directive is arbitrary, capricious, and pretext to remove career federal civil servants and replace them with staff who are politically aligned with the Trump administration. 

The plaintiffs requested a declaratory judgment that the January 28, 2025 directive was unlawful, a preliminary and permanent injunction barring implementation of the February 6, 2025 deadline, and attorneys' fees. They also requested that the court vacate the directive, remand to OPM, and order OPM to notify the email recipients with a court-approved corrective communication. 

On February 5, 2025, the plaintiffs sought a temporary restraining order (“TRO”) to stay the February 6, 2025, deadline for federal employees to accept the government's offer until the court had a chance to adjudicate the case. The following day, Judge O’Toole stayed the deadline until at least February 10, 2025. Judge O’Toole also ordered the defendants to provide notice of the extension to federal employees, which the defendants filed with the court on February 6, 2025. 

On February 10, 2025, after a hearing on the plaintiffs’ request for a TRO, Judge O’Toole retained the stay of the defendants' February 6, 2025 deadline for federal employees to participate in the “deferred resignation” program until further order of the court. In response, OPM sent an email to federal employees informing them of the court’s decision and stating that “the program remains open to resignations,” but “OPM intends to close the program to new entrants as soon as legally permissible.”

However, on February 12, 2025, Judge O'Toole dissolved the TRO and denied a longer-lasting preliminary injunction. The court ruled that the plaintiffs did not have standing, because they were not directly injured by the policy, and also that the Federal Service Labor-Management Relations Statute and the Civil Service Reform Act provided the exclusive procedures for disputes involving employees and their federal employers and disputes between unions representing federal employees and the federal government, foreclosing review under the Administrative Procedure Act (APA). 2025 WL 470459. 

On March 31, 2025, the plaintiffs filed an amended complaint. One of the four labor organizations representing civilian federal employees is no longer a plaintiff. In addition, the amended complaint included several examples of harm to the plaintiffs' individual members as a result of the Fork Directive; that the plaintiffs cannot file these claims with the Federal Labor Relations Authority and their members cannot file them with the Merit Systems Protection Board; and that there is a live case and controversy despite the Fork Directive closing to new sign ups on February 12, 2025. Relief was sought under the APA, including that OPM did not comply with the notice and comment rulemaking requirements; the Directive was arbitrary and capricious for several reasons; and OPM's actions exceeded any statutory authority granted to it by Congress. This time, the plaintiffs also brought a Separation of Powers claim. Their request for declaratory relief included that any employment-related retaliation based on a current or former worker's choice is unlawful, and their request for injunctive relief included that OPM must perform a notice and comment process before implementing any revised Directive. Lastly, the plaintiffs' counsel was expanded to include the law firm Keker, Van Nest & Peters LLP. 

In response, on May 8, the government filed a motion to dismiss. They largely pointed to Judge O'Toole's February 12th decision denying the plaintiffs' request for a preliminary injunction. The government argued that, back then, the court already concluded that it lacked jurisdiction for two different reasons, and the plaintiffs’ amended complaint had done nothing to change that reasoning. Specifically, they argued: (1) the plaintiffs’ claims are foreclosed by the comprehensive remedial scheme enacted by Congress in the Civil Service Reform Act of 1978 (“CSRA”), including the portions of the CSRA that specifically govern federal labor relations, the Federal Service Labor-Management Relations Statute; (2) the plaintiffs continue to lack standing under the theories of harm they previously asserted, as well as their newer proposed pathways; (3) a new reason the plaintiffs’ APA claims fail is because they have identified no final agency action; and (4) the plaintiffs' new claim, invoking non-statutory ultra vires review, is foreclosed by the test governing when such review may be invoked. The plaintiffs filed their response on June 5, 2025.
