Several unions of federal, public, and private employees brought this case in the U.S. District Court for the District of Columbia on Feb. 5, 2025, asking the court to stop Elon Musk’s team (the "Department of Government Efficiency" or DOGE) from accessing Department of Labor (DOL) systems.  The American Federation of Labor and Congress of Industrial Organizations, the American Federation of Government Employees, the American Federation of State, County, and Municipal Employees, Service Employees International Union, Communication Workers of America, and the Economic Policy Institute are represented by the Democracy Forward Foundation.  

Plaintiffs brought this lawsuit against DOGE and the Department of Labor. They pointed out that the Department of Labor collects extremely sensitive data related to American citizens' complaints and claims regarding work-place injuries, worker protection, workplace safety concerns, and more, including claims and complaints relevant to Elon Musk's own companies. They alleged in their complaint that DOL leadership told staff to hand over this information to DOGE-affiliated individuals, without regard to the privacy and use protections required by law, or risk being fired. The asserted claims against the Trump Administration under the Administrative Procedure Act and Privacy Act, and argued that DOGE had no authority of law to access such DOL records. 

On February 5, 2025 (immediately after filing the Complaint), Plaintiffs filed a motion for a temporary restraining order (TRO). On February 7, 2025, after a hearing, Judge Bates denied the motion based on standing and the likelihood that federal court intervention was foreclosed by the statute sending federal employee disputes to administrative adjudication.  He instructed the parties to file a proposed briefing schedule on a preliminary injunction. 

As of February 12, 2025, this case is ongoing.
