This case challenges allegedly unauthorized access to federal financial systems by associates of the "Department of Government Efficiency." On February 7, 2025, 19 states (led by New York, and including Arizona, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Maine, Maryland, Massachusetts, Minnesota, Nevada, New Jersey, North Carolina, Oregon, Rhode Island, Vermont, and Wisconsin) filed this lawsuit in the U.S. District Court for the Southern District of New York. The plaintiff states sued President Donald J. Trump and the U.S. Department of the Treasury under the Administrative Procedure Act, the Separation of Powers doctrine, and the Take Care Clause of the U.S. Constitution. Represented by their respective state attorneys general, the plaintiffs sought a Temporary Restraining Order and a more permanent injunction. They claimed that the defendants unlawfully expanded access to Treasury financial systems, risking unauthorized data use and potential misuse of federal funds.

Early the following morning (Saturday, Feb. 8, 2025), District Judge Paul Engelmayer issued an order that stated that the case had been assigned to District Judge Jeannette A. Vargas, who would have a hearing on Feb. 14, but that in the meantime, Judge Engelmayer would grant emergency relief.  Judge Engelmayer explained, "That is both because of the risk that the new policy presents of the disclosure of sensitive and confidential information and the heightened risk that the systems in question will be more vulnerable than before to hacking."   He said that the States had shown a likelihood of success on the merits of their claims. Pending that Feb. 14 hearing, he said, the defendants were barred from granting access to any Treasury Department payment system or data to anyone other than civil servants within the Bureau of Fiscal Services, with a job need for access and who had passed background checks and security clearances and taken all required information security training.  These could not be political appointees, Special Government Employees, or anyone detailed to Treasury from elsewhere. In addition, anyone now prohibited from having access was required to destroy any records they had obtained or downloaded. 

The next day, defendants filed an emergency motion to vacate the TRO; after briefing, on February 11, 2025, the court did modify its prior order slightly, to allow access to "any Officer of the United States Department of the Treasury nominated by the President and confirmed by the United States Senate"--which included the Treasury Secretary and Deputy Secretary. 

The case was more permanently assigned to District Judge Jeannette Vargas, who, after the preliminary injunction hearing on Feb. 14, 2025, kept the TRO in place while she considered the preliminary injunction request.  Then on Feb. 21, 2025, she granted a preliminary injunction barring the Treasury Department from granting access to any member of the DOGE team within the Treasury Department to any payment record, payment systems, or any other data systems maintained by the Treasury Department containing personally identifiable information and/or confidential financial information of payees.  The court said, however, that if the government cured the procedural defects relating to the protection of sensitive information, it could seek a modification of the order. 

On March 7, 2025, Plaintiffs filed a motion for reconsideration (ECF No. 104) regarding the zone-of-interests ruling in the Opinion and Order granting the Preliminary Injunction (ECF No. 76). Additionally, in a status report filed on March 5, 2025, Defendants indicated their intent to file a motion to partially dissolve the Preliminary Injunction as to Ryan Wunderly on March 10, 2025 (ECF No. 98). Given the interrelated nature of these motions, Judge Vargas set a briefing schedule allowing them to be considered together. Defendants must file their motion to partially dissolve the Preliminary Injunction by March 10, 2025. Oppositions to both motions—Defendants' opposition to the motion for reconsideration and Plaintiffs' opposition to the motion to partially dissolve the Preliminary Injunction—were due by March 14, 2025. Reply briefs must be filed by March 17, 2025. After receiving extensive declarations from multiple Treasury officials, the court ruled on April 11, 2025, denying plaintiffs’ reconsideration motion and granting defendants’ request to partially dissolve the injunction as to Wunderly. The court found that the Treasury Department had adequately addressed the procedural deficiencies previously identified—regarding training, vetting, hiring authority, mitigation, and reporting structure—thus justifying a narrow modification of the injunction. The ruling allowed Wunderly access to BFS payment systems upon completion of hands-on training and submission of his financial disclosure forms.

Defendants filed a motion to vacate the entire preliminary injunction on May 1, 2025. On May 16, the defendants filed a letter, asking the court to "expeditiously" modify the PI to allow four additional DOGE team members access. The defendants alleged that the team members had undergone similar training to Wunderly and therefore requested that they be allowed access. The plaintiffs filed an amended complaint on May 23. The amended complaint added additional details on the creation of DOGE, its membership, and alleged security breaches that took place prior to the lawsuit. It also contained details about DOGE employees and potential conflicts of interest, as well as DOGE's conduct at other government agencies. Additionally, it provided details on how DOGE's actions could cause harm to the states. The complaint also consolidated the causes of action, removing allegations that the defendants' actions exceeded statutory authority under the APA and were ultra vires. 

The amended complaint also requested different relief, asking the court to permanently bar DOGE access without compliance with federal statutes, and adding a request for a permanent injunction barring the defendants from implementing a new process for reviewing federal funding payment requests. 

On May 27, the court denied the defendants' motion to dissolve the preliminary injunction, referencing its earlier finding that the plaintiffs had shown a need for court protection. However, the court modified the injunction to allow DOGE employee access, provided that the employees comply with the "Training, Vetting, and Mitigation Procedures" laid out by the court, which require an employee to go through the same procedures required of all other Treasury employees provided with similar access. 

The parties then agreed, and the court ordered, a schedule to brief a government motion to dismiss the amended complaint, running through September 2025. This case is ongoing.

ORDER re: 3 Proposed Order to Show Cause With Emergency Relief filed by State of New York: The Court accordingly: ORDERS that the defendants show cause before the Hon. Jeannette A. MEMORANDUM OPINION AND ORDER re: 11 EMERGENCY MOTION to Vacate 6 Order . filed by U.S. Department of Treasury, Donald J. Trump, Bessent Scott. Accordingly, the Court GRANTS IN PART AND DENIES IN PART the motion to modify the TRO to clarify its reach. Specifically, the second decretal paragraph of the TRO is modified as followed: ORDERED that, sufficient reason having been shown therefor, pending the hearing of the States' application for a preliminary injunction, pursuant to Rule 65 of the Federal Rules of Civil Procedure, the defendants are (i) restrained from granting access to any Treasury Department payment record, payment systems, or any other data systems maintained by the Treasury Department containing personally identifiable information and/or confidential financial information of payees, other than to career employees with a need for access to perform their job duties within the Bureau of Fiscal Services who have passed all background checks and security clearances and taken all information security training called for in federal statutes and Treasury Department regulations; (ii) restrained from granting access to all political appointees, special government employees, and government employees detailed from an agency outside the Treasury Department, to any Treasury Department payment record, payment systems, or any other data systems maintained by the Treasury Department containing personally identifiable information and/or confidential financial information of payees, EXCEPT THAT this Order shall not apply to any Officer of the United States Department of the Treasury nominated by the President and confirmed by the United States Senate, in accordance with the Appointments Clause of Article II of the Constitution (including the Secretary of the Treasury and the Deputy Secretary of the Treasury); and (iii) ordered to direct any person prohibited above from having access to such information, records and systems but who has had access to such information, records, and systems since January 20, 2025, to immediately destroy any and all copies of material downloaded from the Treasury Department's records and systems, if any. Notwithstanding the above, nothing in this Order prevents (i) contractors on the approved outside contractor list maintained by the Department of Treasurys Chief Information Officer who were engaged prior to January 20, 2025, to perform routine or emergency maintenance on BFS systems from accessing such systems to perform routine or emergency maintenance, or (ii) the Federal Reserve Bank of Kansas City from continuing to access BFS payment systems as it did prior to January 20, 2025, pursuant to the letter of designation with the Treasury in effect prior to January 20, 2025.
