On February 29, 2024, a blind individual filed this class action lawsuit against Uber in the United States District Court for the District of Columbia. The lawsuit named Uber Technologies, Inc. and its subsidiaries, Rasier, LLC and Drinnen, LLC, as Defendants. Represented by Eric Siegel Law, the Plaintiff alleged that Uber did not adequately train its drivers to accommodate visually impaired riders in violation of the Americans with Disabilities Act (ADA) and two DC laws – the DC Human Rights Law and the DC Consumer Protection Procedures Act. In the Complaint, Plaintiff claimed that Uber’s service was a place of public accommodation under the ADA and that Uber unlawfully denied people with disabilities full and equal access to its service. Plaintiff sought declaratory judgment, injunctive relief, and damages.

On April 10, 2024, Plaintiff filed an Amended Complaint detailing a request for class certification for a nationwide 23(b)(2) class defined as “all blind or visually disabled individuals who use service animals and who have attempted to access or been deterred from attempting to access or from accessing Uber transportation services in whole or in part because they use a service animal.” The Amended Complaint also specified that the request for injunction included providing trainings for drivers and helpline staff, implementing a Helpline phone number for disabled patrons, and conducting tests of drivers to ensure adherence.

Defendants filed a motion to compel arbitration and to stay the action until the arbitration concluded on July 15, 2024. Defendants claimed that Uber’s terms and conditions, to which Plaintiff agreed, included a valid agreement to arbitrate substantive disputes and disputes about enforceability and arbitrability. On January 7, 2025, District Court Judge Amir H. Ali granted Defendants’ motion. The Court determined that it was consistent with Federal Arbitration Act precedent to enforce the arbitration clause of the Terms of Use agreement.

Pursuant to the January 2025 Order, this lawsuit has been stayed pending completion of arbitration. The case is ongoing as of March 31, 2025.
