This is a case about a vacated U.S. Department of Labor rule that would have frozen wages for thousands of farmworkers.

On November 30, 2020, a farmworkers union and a nonprofit dedicated to aiding farmworkers and low-income immigrants filed this lawsuit against the U.S. Department of Labor (DOL) in the United States District Court for the Eastern District of California. Plaintiffs challenged the DOL's final rule changing how the DOL would set wage rates for agricultural visa-holders, alleging that the rule violated the Administrative Procedures Act (APA) as it was arbitrary and capricious as well as a violation of the notice-and-comment rule making requirement. Plaintiffs further alleged that the final rule contravened the Immigration and Naturalization Act's (INA) mandate that DOL ensure that the hiring of temporary foreign workers will not adversely affect the wages and working conditions of other workers in the United States. Plaintiffs asked for preliminary and permanent injunctive relief to halt implementation of the Final Rule, declaratory judgment, an order vacating and setting aside the rule, and attorneys' fees. 

DOL fulfilled the INA mandate by establishing an Adverse Effect Wage Rate (AEWR) for each state. The AEWR is essentially a minimum wage that employers using the H2A temporary workers program must pay to both U.S. and foreign guest farmworkers. DOL established the AEWR through the Farm Labor Survey (FLS), a comprehensive survey of wages paid by farmers and ranchers. DOL proposed the challenged Final Rule on November 5, 2020 which would change the methodology for calculating AEWRs. The Final Rule would have frozen wages based on 2019 FLS data and instead use Employment Cost Index (ECI) data to calculate future AEWRs starting in 2023. ECI data showed a much slower rate of wage increases than the FLS data, but importantly surveyed other private sectors and not the agriculture sector. 

The case was assigned to District Judge Dale A. Drozd and Magistrate Judge Jennifer L. Thurston on December 1, 2020. 

On December 23, 2020, District Judge Drozd granted Plaintiffs' motion for a preliminary injunction. The court found that Plaintiffs demonstrated a likelihood of success on their claim that the Final Rule is arbitrary and capricious because it was unsupported by and lacked adequate reasoning. District Judge Drozd found Plaintiffs' arguments compelling that the Final Rule would arbitrarily freeze H2A wages for two years, as the DOL provided little justification for the freeze or switch to ECI data. Finding that Plaintiffs demonstrated a likelihood of success on all three of their claims, the court found that farmworkers would suffer irreparable harm absent granting injunctive relief and halting the Final Rule's implementation. The court ordered that the parties meet and exchange proposals for a proposed order to set the 2021 AEWRs consistent with the court's order. 

On January 12, 2021, District Judge Drozd issued a supplemental order regarding the preliminary injunctive relief. The court ordered that the DOL publish the 2021 AEWRs in the Federal Register using the DOL's 2010 final rule and the FLS data by February 25, 2021. In the interim, the court ordered the DOL to notify agencies, employers, and the public that the 2020 AEWRs would remain in effect until the 2021 publication. 

On March 11, 2021, Plaintiffs filed a motion to extend the preliminary injunctive relief in the form of equitable restitution. Plaintiffs asked that the court order the DOL to direct H2A program employers to make wage adjustment payments to compensate farmworkrers for the difference in wages paid and the 2021 AEWRs, an amount likely exceeding $10 million.

On May 13, 2021, District Judge Drozd granted this motion and ordered that farmworkers be given the backpay for days worked between January 15 and February 23, 2021. In reaching that conclusion, he wrote that to not order the wage adjustment would amount to giving legal effect to an the DOL's invalid order and the farmworkers were therefore entitled to equitable restitution. The court ordered that the DOL inform H2A employers who submitted job orders and applications for H2A labor certification in the interim period of the wage adjustments, giving them 60 days to comply and certify that the adjustments were made. 

On January 5, 2022, Plaintiffs filed a motion for summary judgment. Plaintiffs asked the court to vacate and remand the Final Rule since both the court and the DOL itself found it to be legally flawed. The DOL replied with a request that the court permit it to conclude it's rule making process before adjudicating the motion. The DOL asked that the court hold the motion in abeyance as the 2022 AEWRs had already been published and argued that Plaintiffs would not suffer any harm. 

On April 4, 2022, District Judge Drozd granted Plaintiffs' motion for summary judgment, ordered that the Final Rule be vacated, remanded to the DOL for further rule making, and directed this case to be closed. The court affirmed the findings that it had made for the preliminary injunction order. The court found that (1) the Final Rule contravened the INA by failing to protect US workers against adverse effects to their wages and working conditions; (2) the Final Rule failed to offer a reasoned explanation for the wage freeze; and (3) the Final Rule failed to adhere to notice-and-comment requirements. The court declined to hold the motion in abeyance because there was a slight risk that the 2020 Final Rule will again become operative so long as it only remains subject to the preliminary injunction. To avoid that potential harm, the court found it necessary to vacate the 2020 Final and close this case. 

This case is closed.

Drozd on 6/8/2021: (Text Only Entry) The court has reviewed the parties' joint status report filed on June 3, 2021, in which modifications to the court's May 14, 2021 have been requested. (Doc. No. 64 .) The court is prepared to issue a final order addressing the parties' requests for modification. However, the court requires clarification as to one of the statements made in the status report. Therein, plaintiffs state: "Even if the Order were to apply more broadly to all employers that submitted applications during the December 21, 2020, to February 23, 2021 period, recent data published by DOL suggests that only 6,464 farmworkers would potentially receive the benefit of the Court's order because they worked for an employer that submitted an H-2A application between December 21, 2020, and February 23, 2021, and sought workers for the January 15 to February 23, 2021 period." (Id. at 5.) The court does not understand this characterization of its May 14, 2021 order as "more broadly" since that order stated that: "H-2A employers who submitted job orders and applications for H-2A labor certification between December 21, 2020 and February 23, 2021 are required to make wage adjustment payments to qualifying H-2A workers and U.S. farmworkers in corresponding employment who worked during the period from January 15, 2021 to February 23, 2021 and received an hourly wage below the geographically applicable 2021 AEWR[.]" (Doc. No. 58 at 13.) Accordingly, the parties are directed to address this issue by filing supplemental briefing of not more than three (3) pages in length by 9:00 a.m. PT on June 10, 2021.
