On October 14, 2020, a group of 181 U.S. citizens and lawful permanent residents filed this lawsuit in United States District Court for the Northern District of California. Plaintiffs brought this suit seeking declaratory and injunctive relief against President Trump, the Department of State, and the Department of Homeland Security under the Administrative Procedure Act (APA), 5 U.S.C. § 706(2). The plaintiffs sought a writ of mandamus for immigration benefits, an order declaring the Presidential Proclamations related to immigration exceed the Executive Branch’s lawful authority, and enjoin the defendants from implementing and carrying out the provisions of the Proclamations. The case was first assigned to Magistrate Judge Donna M. Ryu and later reassigned to Judge Edward Chen.

The claims arose from Presidential Proclamation 10014, issued on April 22, 2020 (later extended through Proclamation 10052), which banned the entry into the United States of all aliens as immigrants, with nine narrow exceptions. The President claimed the order was in response to COVID-19. As a result, the plaintiffs were separated from family members who had previously approved immigrant visas that were revoked as a result of the Proclamation.

On October 15, 2020, the plaintiffs filed a motion for preliminary injunction seeking an order declaring the Proclamations unlawful and in excess of the Executive Branch’s lawful authority; an order declaring the implementation of the Proclamations unconstitutional; an order vacating and setting aside the Proclamations and any actions taken to implement them; an order declaring the defendants’ “emergency” designation require for adjudication of immigrant visa applications unlawful; an order declaring the defendants’ “Diplomacy Strong” policies unlawful; and an order mandating the immediate processing and adjudication of immigrant visa applications. 

On December 11, 2020, the court granted the plaintiffs’ motion for preliminary injunction. Judge Chen enjoined the defendants from implementing or carrying out the substances of Proclamation 10014, and ordered them to effectuate the processing of the plaintiffs’ visas. 

One of two related cases was filed on January 11, 2021. In Jacob v. Trump (1:21-cv-00261; see also 1:21-cv-01874),2,196 immigrant visa applicants brought a class action lawsuit against then-President Trump seeking declaratory and injunctive relief in a challenge to the legality of Presidential Proclamation 10014 and its implementation. The class consisted of applicants in various preference categories such as “family preference” and “Diversity Visa.” This case was ultimately transferred to the next related case, Goodluck v. Biden, on July 13, 2021.

On February 9, 2021 the defendants filed a notice of appeal to the Ninth Circuit Court of Appeals (Docket: 21-15233). President Biden revoked the Proclamation at issue on February 24, 2021 and submitted an unopposed motion to dismiss the appeal on the same day. The motion to dismiss the appeal was granted on March 16, 2021. 

On April 22, 2021, President Biden’s administration submitted a motion to dismiss the case as moot in District Court because the President revoked Proclamation on February 24, 2021.

The second related case, Goodluck v. Biden (3:21-cv-00261), filed on June 7, 2021, the plaintiffs, recipients of Fiscal Year 2020 and 2021 “Diversity Visas” sought declaratory and injunctive relief because their ability to receive a visa under that preference category was limited to the year in which they were selected. The plaintiffs were first awarded remedial relief in the form of allocations in the next fiscal year but this was reversed by the United States Supreme Court. On June 25, 2024, on remand, the United States Court of Appeals for the D.C. Circuit held that the plaintiffs lost their eligibility once the respective Fiscal Year ended.  This ended the case.

On June 10, 2021, the plaintiffs filed a notice of voluntary dismissal and the case was dismissed by Judge Chen on July 7, 2021. 

This case is now closed.
