This is a case about Venezuelans who had been ordered to be deported but, due to strained relations between the United States and Venezuela, had been detained indefinitely. 

Plaintiffs are three Venezuelans who were detained by the U.S. Immigration and Customs Enforcement (ICE) for more than nine months. Represented by the ACLU of New Mexico, Las Americas Immigrant Adv. Center, and the Center for Constitutional Rights, plaintiffs filed this lawsuit on September 13, 2024 in the United States District Court for the District of New Mexico. Plaintiffs sued ICE, the United States, the Department of Homeland Security, and the Otero County Processing Center. This case was assigned to District Judge Kenneth J. Gonzales.

Plaintiffs in this case were ordered removed by immigration judges and did not appeal. Venezuela announced “it would cease receiving deportation flights from the U.S. as of February 13, 2024, in response to the economic sanctions that the United States re-imposed on Venezuela after previously lifting them in 2023.” This coupled with the United States declining to recognize Nicolás Maduro as President of Venezuela deteriorated relations such that it appeared unlikely that deportation flights would be accepted in the reasonably foreseeable future. 

Plaintiffs sued defendants under the Immigration and Nationality Act, 8 U.S.C. § 1231, and alleged violation of the Due Process Clause of the Fifth Amendment. They sought declaratory relief and a writ of habeas corpus. 

By Presidential Memorandum dated Jan. 29, 2025, President Trump ordered the Secretary of Defense and the Secretary of Homeland Security to expand the Migrant Operations Center at Naval Station Guantánamo Bay to full capacity "to provide additional detention space for high-priority criminal aliens unlawfully present in the United States, and to address attendant immigration enforcement needs." On February 9, 2025 Plaintiffs filed an opposed motion for a temporary restraining order to enjoin their potential transfer to Guantánamo Bay. They claim that such transfer would compromise plaintiffs’ access to counsel and implicate the Court’s jurisdiction. The court granted the motion on February 9, 2025 due to uncertainty surrounding jurisdiction. The next day, DHS deported the three plaintiffs to Venezuela. The case has been voluntarily dismissed.
