This case alleged that the U.S. government unlawfully disclosed millions of Americans' sensitive personal information to an unvetted group led by Elon Musk. On February 10, 2025, three non-profit and labor organizations and 6 current or retired federal workers filed this lawsuit in the United States District Court for the District of Maryland against the U.S. Department of the Treasury, the U.S. Office of Personnel Management ("OPM"), and the U.S. Department of Education. The Plaintiffs alleged that Defendants had willfully and intentionally permitted their personal information to be accessed by individuals affiliated with the Department of Government Efficiency ("DOGE") without legal justification and in violation of the Administrative Procedure Act. Represented by public interest counsel, the plaintiffs sought injunctive relief and declaratory relief, claiming that the defendants unlawfully permitted DOGE-affiliated individuals outside the government to access personal data without legal justification. 

Plaintiffs included the American Federation of Teachers, the International Association of Machinists and Aerospace Workers, the National Active and Retired Federal Employees Association, and the National Federation of Federal Employees. These organizations, along with individual plaintiffs consisting of current and retired federal workers, alleged that their personal data—including Social Security numbers, financial records, and home addresses—was improperly disclosed. The complaint stated that representatives of DOGE, an initiative created by an executive order issued by President Trump on January 20, 2025, were granted access to sensitive federal databases without appropriate clearance or oversight.

The Plaintiffs claimed that the Defendants violated the Privacy Act of 1974, which established protections for government-held personal data, and the Administrative Procedure Act, which governed how federal agencies make decisions. Plaintiffs argued that these disclosures exposed individuals to serious risks such as identity theft, harassment, and financial fraud. They sought injunctive relief to immediately block further unauthorized disclosures, as well as declaratory relief affirming that the government’s actions were unlawful. The case was assigned to District Judge Deborah L. Boardman. 

Shortly after the lawsuit was filed, Plaintiffs moved for a preliminary injunction to halt further disclosures while the case was pending. The court scheduled an evidentiary hearing to assess the urgency and merits of this request. Meanwhile, Defendants filed a motion to dismiss, arguing that the plaintiffs lacked standing and that DOGE’s access to federal records was lawful under executive authority.

The case drew significant public attention due to the involvement of Elon Musk and allegations that DOGE-affiliated personnel included individuals without appropriate security clearances. Reports surfaced indicating that at least one DOGE representative had administrative-level access to federal payment and personnel systems, allowing them to modify records and potentially disrupt government operations. Plaintiffs cited these developments to strengthen their argument that urgent court intervention was necessary.

On February 24, 2025, the court issued a temporary restraining order ("TRO") enjoining the Department of Education officials from disclosing personally identifiable information of the plaintiffs and the members of the plaintiff organizations to any DOGE affiliates, including those working at the Department of Education, until March 10, 2025 at 8:00 a.m. The order did not include disclosures to the Department of Treasury.  The parties were instructed to agree on a briefing schedule for Plaintiffs' preliminary injunction request.  

On March 6, 2025, the court extended the February 24 TRO from March 10, 2025, at 8:00 a.m. to March 17, 2025, at 5:00 p.m., or until the court ruled on the forthcoming preliminary injunction motion—whichever occurred earlier. This extension was intended to maintain the status quo and prevent irreparable harm while the defendants produced the administrative record, the parties briefed the preliminary injunction motion, and the court held a hearing on that motion. The court indicated that it might extend the TRO for an additional period, but not beyond March 24, 2025, at 8:00 a.m.

On March 17, 2025, the court extended the TRO once again, pushing the deadline from March 17, 2025, at 5:00 p.m. to March 24, 2025, at 8:00 a.m., or until the court ruled on the plaintiffs' preliminary injunction motion—whichever occurred first. The extension was granted to maintain the status quo and prevent further unauthorized disclosures while the court considered the plaintiffs' request for a preliminary injunction. Judge Boardman emphasized that there was good cause for the extension, given the potential for irreparable harm. This order meant that the Department of Education remained barred from sharing personally identifiable information with DOGE affiliates, while the case moved forward.

On March 24, 2025, Judge Boardman granted the plaintiffs’ motion for a preliminary injunction. The court enjoined the Department of Education, OPM, and the Department of the Treasury from disclosing the personally identifiable information of the plaintiffs and members of the plaintiff organizations to any DOGE affiliates. DOGE affiliates were defined as individuals primarily tasked with implementing the DOGE agenda and who had been granted access to agency records for that purpose. Notably, the order specifically included DOGE personnel embedded in the Treasury Department, such as Thomas Krause and Ryan Wunderly, while excluding top OPM officials. The court denied plaintiffs' motion for extra-record discovery without prejudice and required the plaintiffs’ $10,000 security to remain on deposit. The parties were ordered to file a joint status report by March 31, 2025, regarding a potential appeal or case scheduling.​ 

The case remains ongoing.
