On February 11, 2025, current and former federal employees and unions acting on their behalf filed this lawsuit in the United States District Court for the Southern District of New York against DOGE and its Acting Administrator; the Director of the DOGE Temporary Service, Elon Musk; and the U.S. Office of Personnel Management (OPM) and its Secretary (collectively the "OPM Defendants"). Plaintiffs alleged that Defendants had willfully and intentionally permitted their sensitive and protected data to be accessed by DOGE-affiliated individuals outside of the U.S. government without legal justification and in violation of the Administrative Procedure Act and the Privacy Act. 

On Count I, Plaintiffs alleged that Defendants violated the Privacy Act of 1974, 5 U.S.C. § 552a(b), by disclosing Plaintiffs’ and their members’ records to DOGE employees who had no need for the records without consent from Plaintiffs or their members. On Count II, Plaintiffs alleged Defendants violated the Privacy Act, 5 U.S.C. § 552a(e)(10), by failing to establish safeguards to ensure the security and confidentiality of the records they gave to DOGE. On Count III, Plaintiffs alleged that Defendants' actions were "arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law" in violation of the Administrative Procedure Act, 5 U.S.C. § 706(2)(A). On Count IV, Plaintiffs alleged that the OPM Defendants "failed to engage in reasoned decision-making" when they allowed DOGE to access records for purposes other than those allowed by the Privacy Act, in violation of the Administrative Procedure Act, 5 U.S.C. § 706(2)(A). Last, on Count V, Plaintiffs alleged that DOGE had no authority to take any action other than to advise and assist the President; as such, its direction and control over OPM constituted ultra vires actions that violated federal laws.

Plaintiffs sought (1) declaratory relief; (2) injunctive relief enjoining Defendants from permitting such access or obtaining such personal information or to make any use of the information already obtained; (3) the impoundment and destruction of all copies of individuals’ personal information that had been disclosed; and (4) attorneys' fees and costs.

The case was assigned to Judge Victor Marrero and Magistrate Judge Gary Stein. The case was reassigned to Judge Denise L. Cote shortly after. 

On February 14, 2025, Plaintiffs filed a motion for temporary restraining order (TRO). Plaintiffs sought a restraining order enjoining Defendants: (1) from disclosing to DOGE-affiliated agents any OPM records or access to such records, and from allowing DOGE agents to obtain personal information about individuals contained in the records; (2) to ensure future disclosure of individual records would occur 
only in accordance with federal law; (3) to impound and destroy all copies of the personal information unlawfully disclosed to DOGE; (4) to file a status report within 48 hours of the grant of the TRO indicating whether the records were destroyed and whether DOGE-affiliated agents continued to have access to the OPM records.

The following month, on March 14, Defendants filed a motion to dismiss. Defendants argued that Plaintiffs failed to establish standing, as they failed to establish an injury in-fact. Further, Defendants argued that Plaintiffs' claims were not reviewable under the APA, as they did not identify the requisite final agency action and they have an adequate remedy under the Privacy Act. Defendants also alleged that Plaintiffs did not plausibly allege a violation of the Privacy Act because they did not plausibly prove that the DOGE employees were not OPM employees.

The court ordered a protective motion on March 19 to govern the disclosure, use, and handling, of information contained in the administrative records to be produced by Defendants. The court sought to protect confidential information that may be produced as part of OPM’s administrative record. 

This case is ongoing.

ORDER. On February 11, 2025, the plaintiffs, consisting of unions and current and former federal government employees, filed this action seeking declaratory and injunctive relief against the U.S. Office of Personnel Management, Charles Ezell, the U.S. DOGE Service, the unidentified acting administrator of the U.S. DOGE Service, the U.S. DOGE Service Temporary Organization, and Elon Musk. On the evening of February 14, the plaintiffs filed a motion for a temporary restraining order ("Motion") and requested a prompt hearing. Accordingly, it is hereby ORDERED that, to the extent they have not already done so, the plaintiffs shall serve the defendants with their Motion and accompanying papers. IT IS FURTHER ORDERED that the parties shall meet and confer promptly regarding (1) a schedule for briefing the Motion, and (2) whether there is consent to the proposed temporary restraining order, to any portion of it, or to other actions to be taken by the defendants pending completion of the briefing and a decision by the Court on the Motion. IT IS FURTHER ORDERED that by Tuesday, February 18, 2025 at 10:00 a.m. the parties shall advise the Court of their proposals regarding a briefing schedule and any agreements they have reached. ORDER: On February 11, 2025, the plaintiffs, consisting of unions and current and former federal government employees, filed this action seeking declaratory and injunctive relief against the U.S. Office of Personnel Management ("OPM") and others. On February 14, The plaintiffs filed a motion for a temporary restraining order ("TRO"). Oral argument on that motion was scheduled for February 27. On February 23, the plaintiffs requested that the February 27 conference be adjourned and joined the defendants' request that their motion for a TRO be converted a motion for preliminary injunction. The plaintiffs indicated that they intend to seek expedited discovery and that the defendants intent to move to dismiss the action. On February 24, The Honorable Deborah L. Boardman issued a TRO against OPM. See Am. Fed'n of Teachers, et al. v. Scott Bessent. et al., Case No. 25cv430 (D. Md.), ECF No. 38. Accordingly, it is hereby ORDERED that the parties shall promptly confer regarding a schedule for further proceedings in this action. ORDER granting in part and denying without prejudice in part 51 Motion for Discovery: Accordingly, it is hereby ORDERED that the defendants shall provide to the plaintiffs the administrative record for the actions by OPM at issue in this litigation no later than tomorrow, March 8, 2025. IT IS FURTHER ORDERED that, to the extent further discovery materials relating to those OPM actions are produced in the Maryland Action in connection with the preliminary injunction hearing, those materials shall also be promptly produced to the plaintiffs. IT IS FURTHER ORDERED that the remainder of the plaintiffs' motion for expedited discovery is denied without prejudice to renewal following completion of the preliminary injunction hearing in the Maryland Action.
