On August 16, 2024, two transgender teenage girls and their parents filed this case in the United States District Court for the District of New Hampshire, against the Commissioner of the New Hampshire Department of Education; New Hampshire State Board of Education; the Pemi-Baker Regional School District and its Board; and the Pembroke School District and its Board. The plaintiffs challenged HB 1205, a New Hampshire statute that barred plaintiffs from playing school sports, alleging that the statute violated their rights under the Equal Protection Clause and Title IX. The case was assigned to Judge Landya B. McCafferty.

Before the enactment of HB 1205, transgender athlete participation in high school sports was governed by the New Hampshire Interscholastic Athletic Association (NHIAA). The policy of NHIAA since 2015 had been one of commitment “to providing transgender student-athletes with equal opportunities to participate in NHIAA athletic programs” because “it would be fundamentally unjust and contrary to applicable State and Federal Law to preclude a student from participation on a gender specific sports team that is consistent with the public gender identity of that student for all other purposes.” The policy, therefore, required schools to determine a transgender student athletes’ ability to participate based on: (1) gender identification as noted in school records, and (2) the daily life activities of the student in the school and their community. 

HB 1205 overrode the NHIAA policy after the law went into effect on August 19, 2024. HB 1205 required each interscholastic sport or club team between the fifth and twelfth grade, as well as private schools competing against public schools, to be designated as “boys,” “girls,” or “coed” based on “biological sex”--determined based on the student’s sex assigned at birth as noted on their birth certificate. Notably, students who wished to participate on a girls’ team had to produce their birth certificate, but there was no such requirement for students attempting to participate on a boy’s team. If the school determined that the birth certificate produced was different than the one given at birth, the student and the family bore the financial responsibility of producing “other evidence” to support their eligibility to participate. Finally, HB 1205 prohibited New Hampshire school districts from “entertain[ing[ a complaint, open[ing] and investigation, or tak[ing] any other adverse action against a school for maintaining separate interscholastic sports activities or club athletic teams for students of the female sex.” 

In their original complaint, the plaintiffs argued that HB 1205 violated the Equal Protection Clause of the Fourteenth Amendment as well as Title IX. Under both claims, they argued the law discriminated against transgender students on the basis of sex, as well as singled out transgender student-athlete participation on girls' teams. They requested a declaratory judgment that HB 1205 violated both Title IX and the Equal Protection Clause; as well as a temporary restraining order, preliminary injunction, and permanent injunction against enforcement of the law. 

The same day the plaintiffs filed their complaint, they requested an emergency temporary restraining order (TRO) and a preliminary injunction. The TRO was granted on August 19, 2024, preventing the defendants from enforcing or threatening to enforce HB 1205. The TRO also required the defendants to permit the plaintiffs to try out for, participate with, compete with, and play on the school sports teams designated for girls on the same terms and conditions as other girls. On September 10, 2024, the plaintiffs’ motion for a preliminary injunction was granted, which essentially extended the holding of the TRO, to last while the case was being litigated. 

On December 6, defendants filed a motion to dismiss, which the court denied on February 12, 2025. On February 12, 2025, the plaintiffs filed an amended complaint adding President Donald Trump, the U.S. Department of Justice, the U.S. Attorney General, and the U.S. Department of Education as defendants. This was because, after President Trump took office, he issued two relevant executive orders First, on January 20, 2025, the President issued an executive order titled "Defending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government," which broadly denied transgender people recognition and protection by the federal government. Then, on February 5, 2025, President Trump issued an executive order titled, "Keeping Men Out of Women’s Sports," which banned transgender girls from playing on girls' sports teams at any school that received federal funds. Plaintiffs alleged that the executive orders, much like New Hampshire's HB 1205, violated the Equal Protection Clause and Title IX. They further alleged that the executive orders exceeded the President's constitutional powers and infringed on Congress's powers. 

On February 21, Female Athletes United (FAU) moved to intervene in the case. FAU sought to defend the legality of both HB 1205 and the executive orders. On March 27, 2025, the plaintiffs filed a motion in opposition to FAU entering the case as an intervenor-defendant, arguing "FAU has not and cannot demonstrate an absence of adequate representation by the State of New Hampshire or the federal government." 

Since March, litigation has continued, with briefing on intervention and dismissal extending through August 2025. Both parties filed a joint motion to stay the case until the Supreme Court resolves the legal issues involved in this case.
