This case challenged the denial of counsel to immigrant detainees by the Trump Administration. Plaintiffs alleged that the Administration transferred at least 50 immigrant detainees from the United States to Guantanamo Bay, where they could not communicate with either their families or attorneys. This case challenged the denial of counsel to immigrant detainees by the Trump Administration. Plaintiffs alleged that the Administration transferred at least 50 immigrant detainees from the United States to Guantanamo Bay, where they could not communicate with either their families or attorneys. Plaintiffs alleged violations of their rights to habeas corpus, the First Amendment, the Fifth Amendment, and the Immigration and Nationality Act. 

On February 12, 2025, represented by the ACLU, IRAP, and the Center for Constitutional Rights, several immigration nonprofits and an unknown number of immigrants detained at Guantanamo Bay filed this lawsuit in the U.S. District Court for the District of Columbia. The lawsuit sued the U.S. Department of Homeland Security (DHS), the U.S. Immigration and Customs Enforcement Agency (ICE), the U.S. Department of Defense, the U.S. State Department, and the heads of each. Plaintiffs sought declaratory and injunctive relief, as well as attorneys' fees. The case was assigned to Judge Carl J. Nichols. 

The same day, plaintiffs filed a motion for a temporary restraining order. 

On February 20, 2025, the defendants filed a notice stating that all detainees had been removed from Guantanamo Bay, arguing that this obviated the need for any temporary injunctive relief. They requested that the case move forward on a non-expedited basis.

On March 14, 2025, the court denied plaintiffs' motion for a TRO. 

Plaintiffs amended their complaint on April 26, 2025. The amended complaint dropped the nonprofits as plaintiffs, instead naming two detainees as plaintiffs on behalf of all similarly situated persons. The amended complaint alleged violations of the First and Fifth Amendments only. Plaintiffs moved to certify their proposed class ("all immigration detainees originally apprehended in the United States and detained at U.S. immigration detention facilities, and who are, or will be held at" Guantanamo) the same day. Defendants filed a motion opposing class certification on June 10, 2025.

On June 16, 2025, defendants moved to dismiss, arguing that plaintiffs' claims were moot as they were no longer in U.S. custody; that plaintiffs lacked actual harm sufficient to confer standing; and that plaintiffs failed to state a constitutional claim.

On June 30, 2025, plaintiffs filed their response to defendants' motion to dismiss. Plaintiffs argued that since defendants were the ones who moved plaintiffs away from Guantanamo, two exceptions to mootness applied. Firstly, that claims such as immigration detention are "inherently transitory," and second, that defendants surgically "picked off" named plaintiffs by mooting their claims in advance of a class action. Plaintiffs also argued that they had standing at the time their complaint was filed and that they did state constitutional claims.

The court's decision on both plaintiffs' and defendants' motions is pending. This case is ongoing.
