President Trump was sworn in to his second term as President on January 20, 2025, and immediately issued a number of Executive Orders--including Executive Order 14160, which proclaimed that birthright citizenship under the Fourteenth Amendment does not apply to children born in the United States when: (1) their mother was unlawfully present in the country and their father was neither a U.S. citizen nor a permanent resident at the time of the child’s birth; or (2) when their mother was lawfully, but temporarily, present in the United States and their father was neither a U.S. citizen nor a permanent resident.

On Feb. 13, 2025, the New York Immigration Coalition and a pregnant immigrant with Temporary Protected Status (TPS) and a pending asylum petition filed this lawsuit in the U.S. District Court for the Southern District of New York. They filed this lawsuit against President Donald J. Trump and several U.S. Departments--U.S. Department of Homeland Security, U.S. Department of State, U.S. Department of Justice, the Centers for Medicare and Medicaid Services, and the Social Security Administration. The Plaintiffs challenged Trump's Executive Order purporting to end birthright citizenship, alleging that it violated the Citizenship Clause, the Equal Protection Clause, and 8 U.S.C. § 1401(a). The case was assigned to Judge Margaret M. Garnett and Magistrate Judge Henry J. Ricardo. The plaintiffs sought a declaratory judgment that the Executive Order was unconstitutional and unlawful and permanent injunctive relief preventing the government from enforcing the Executive Order, which was scheduled to go into effect on Feb. 19, 2025.

On March 5, 2025, the plaintiffs filed an amended complaint, adding an individual plaintiff, a pregnant Colombian immigrant with a pending asylum application, and an organization plaintiff, Mid-Hudson Catskill Rural & Migrant Ministry.

On March 21, 2025, the plaintiffs moved for a preliminary injunction, asking the court to prohibit the defendants from implementing and enforcing Executive Order 14160. The motion is pending before the court.

The government moved the court to stay this case on April 11, 2025, arguing that EO 14160 was already the subject of three nationwide injunctions that they were challenging in federal appellate courts. On April 18, the court lifted the government's deadline to respond to the plaintiffs' motion for a preliminary injunction, stating however that "should the Supreme Court lift or alter the current nationwide injunctions in place on this issue, the Government must be prepared to respond promptly to Plaintiffs' Motion for Preliminary Injunction, or, should circumstances necessitate, the Court will permit Plaintiffs to file an immediate motion for a Temporary Restraining Order." The court also extended the government's deadline to respond to the complaint until July 7. 

On June 27, 2025, the Supreme Court issued its decision in State of Washington v. Trump, Casa Inc. v. Trump, and New Jersey v. Trump, each of which challenged universal preliminary injunctions barring implementation of the Executive Order. 2025 WL 1773631. The Supreme Court decided that universal injunctions likely exceed the equitable powers that Congress has given to federal courts if such injunctions provide relief to individuals or entities who are not parties before the court. The correct principle, the Court ruled, was complete relief for the parties, but no more. Therefore, it partially stayed the injunctions issued in these cases, but only to the extent that the injunctions were broader than necessary. Specifically, the Court found that the injunctions were likely overbroad with regard to the individual plaintiffs in these cases, since an injunction barring enforcement only against the individual plaintiffs would give them complete relief. On the other hand, the Court declined to rule on whether the injunctions were overbroad with regard to the State plaintiffs, instead remanding the case to the district courts to consider that question in the first instance.  

Also on June 27, the district court, citing the Supreme Court's decision, issued an order stating that it was going to reopen the plaintiffs' motion for a preliminary injunction on an expedited schedule set to conclude by July 25. Therefore, it ordered the plaintiffs to file any supplemental briefing or amendments to the complaint by July 9. The amended complaint filed by the plaintiffs added an additional individual plaintiff and asked the court to certify the following class: "All persons born in the United States on or after February 19, 2025, who have been or will be denied birthright citizenship because their parents’ immigration statuses are the subject of Executive Order 14160." The amended complaint also added a cause of action under the Administrative Procedure Act. In response, the court ordered the defendants to respond to the request for class certification by July 18.

ORDER On June 27, 2025, the Supreme Court granted, in part, the government's application to stay the injunctions that prevented the implementation and enforcement of the executive order that is the subject of this case. See Trump v. Casa, Inc., 606 U. S. ____ (2025). In their opinion, the Supreme Court ordered that, consistent with the representations of the Solicitor General, the executive order not take effect for at least 30 days (i.e., until July 27, 2025). See id. at 26. This Court previously advised Defendants that, should the Supreme Court lift or alter the relevant nationwide injunctions, Defendants should be prepared to respond promptly to Plaintiffs' Motion for Preliminary Injunction. See Dkt. No. 34. Accordingly, the Court intends to set an expedited briefing schedule for Plaintiffs' Motion for a Preliminary Injunction, and to issue a decision on any request for preliminary injunctive relief by July 25, 2025. Plaintiffs are hereby ORDERED to advise the Court by letter, no later than July 2, 2025, whether they intend to amend their Complaint, substitute individual plaintiffs, or submit supplemental briefing on the Motion for Preliminary Injunction. Any such amendments or supplemental briefing should be filed by July 9, 2025. ORDER granting 46 Motion for Leave to File Document; granting 48 Motion for Confidentiality: On July 9, 2025, Plaintiffs filed three motions, two of which are addressed in this Order. Turning first to Plaintiffs' Motion for Leave to File a Second Amended Complaint (Dkt. No. 46), the Court finds that, under all the circumstances of this case, the interests of justice require granting Plaintiffs leave to file a Second Amended Complaint, pursuant to Federal Rule of Civil Procedure 15(a)(2). Plaintiffs' motion is therefore GRANTED and Plaintiffs are directed to file their Second Amended Complaint (Dkt. No. 46-1) by no later than July 15, 2025. Plaintiff M.P.'s Motion to Proceed Anonymously (Dkt. No. 48) is also GRANTED. As stated previously with respect to Plaintiff J.V. and D.F.'s motions to proceed anonymously, see Dkt. Nos. 4, 5, 14, 16, the decision to grant or deny an application to proceed anonymously is within the sound discretion of the district court. See Sealed Plaintiff v. Sealed Defendant, 537 F.3d 185, 190 (2d Cir. 2008). Having reviewed the Second Amended Complaint and Plaintiff M.P.'s motion, the Court finds that, for substantially the reasons set forth in the prior Orders at Dkt. Nos. 5 and 16, Plaintiff M.P.'s interest in anonymity, at least at this stage of the case, far exceeds any public interest in disclosure or possible prejudice to Defendants. See id. at 189. This ruling is subject to reconsideration if the Defendants oppose the request within three (3) days of this Order, or if the Court finds that there are material changes in the circumstances on which Plaintiff M.P.'s motion is based.
