This case is one of several challenging President Trump's effort to narrow birthright citizenship--the Fourteenth Amendment right to U.S. citizenship to individuals born on U.S. soil and "subject to the jurisdiction thereof." You can see all these cases here

President Trump was sworn in to his second term as President on January 20, 2025, and immediately issued a number of Executive Orders--including Executive Order 14160, which proclaimed that birthright citizenship under the Fourteenth Amendment does not apply to children born in the United States when: (1) their mother was unlawfully present in the country and their father was neither a U.S. citizen nor a permanent resident at the time of the child’s birth; or (2) when their mother was lawfully, but temporarily, present in the United States and their father was neither a U.S. citizen nor a permanent resident.

This case was filed on Jan. 21, 2025, in the U.S. District Court for the District of Massachusetts. The plaintiffs included eighteen states, the District of Columbia, and the City and County of San Francisco. The defendants included President Trump, the Department of State, the Department of Homeland Security, the Department of Health and Human Services, and the Social Security Administration. The case was assigned to District Judge Leo Sorokin. 

The plaintiffs alleged that the Executive Order violated the Citizenship Clause of the Fourteenth Amendment, separation of powers under Articles I and II of the U.S. Constitution, the Immigration and Nationality Act under 8 U.S.C. § 1401, and the Administrative Procedure Act under 5 U.S.C. §§ 706(2)(A)-(D). The plaintiffs sought preliminary and permanent injunctions enjoining the defendants from enforcing the Executive Order, which was scheduled to go into effect on February 19, 2025, and a declaratory judgment that the Order is unconstitutional and unlawful. The plaintiffs also asked the court to vacate any actions that defendant agencies take to implement or enforce the Executive Order. 

Simultaneously with the complaint, the plaintiffs moved for a preliminary injunction enjoining the defendants from implementing or enforcing Executive Order 14160 pending the resolution of this action. The court determined that this case and Doe v. Trump--another lawsuit challenging EO 14160 in the same court--were "related" under Local Rule 40.1(g), so considered both cases' preliminary injunction motions together. 

On Feb. 4, 2025, a coalition of 18 members of Congress--led by Rep. Jim Jordan--who serve on the Judiciary Committee filed an amicus brief arguing that the court should deny the plaintiffs' motion for a preliminary injunction in this case based on an argument that "jurisdiction" entails "allegiance to the sovereign," which, they argue, does not apply to the children of those whom this Executive Order applies. On Feb. 5, the State of Tennessee also filed an amicus brief in support of the defendants, rejecting the plaintiffs' interpretation of birthright citizenship and arguing that "[c]onferring United States citizenship requires a more meaningful connection than mere presence by happenstance or illegality." 

Judge Sorokin granted a nationwide preliminary injunction on Feb. 13, 2025.

The following day, the preliminary injunction order was appealed to the First Circuit by two individuals, one of whose pro se emergency and ex parte Motion to Intervene had been previously denied by the court, and who later moved to voluntarily dismiss the appeal. On Feb. 23, 2025, the appellants filed an emergency motion to stay the district court's order granting the preliminary injunction.

On Feb. 19, 2025, the defendants also appealed the preliminary injunction order to the First Circuit. The defendants moved to stay the preliminary injunction in the district court, and the district court denied their motion on Feb. 26, 2025.

Furthermore, on Feb. 24, 2025, a different individual appealed an earlier decision in this case -- in which the district court denied his pro se "Notice of Brazenburg v. Hayes Motion" to the extent that it sought dismissal of this action -- to the First Circuit. 

On March 11, 2025, the First Circuit--with Chief Judge Barron writing for the court--denied the government's motion to stay the injunction pending appeal. The injunction remains in place while the appeal proceeds in the First Circuit. 

In the United States Supreme Court, on March 13, 2025, Acting Solicitor General Harris filed an application for a partial stay of the district court's injunctions in this case, in State of Washington v. Trump, and in State of New Jersey v. Trump. Arguing that the injunctions improperly grant relief to non-parties and prevent the executive branch from taking steps to implement the Executive Order, the Solicitor General asked the Supreme Court to stay the preliminary injunction "in this case except as to the five individual respondents and the eleven members of the organizational respondents identified in the complaint." The challengers' response is due by April 4, 2024. 

On March 14, 2025, a coalition of 18 members of Congress--led by Rep. Jim Jordan--who serve on the Judiciary Committee filed an amicus brief in the Supreme Court, supporting the government's application for stays in these three cases.

In the United States Supreme Court, on March 13, 2025, Acting Solicitor General Harris filed an application for a partial stay of the district court's injunctions in this case, in State of Washington v. Trump, and in CASA Inc. v. Trump. Arguing that the injunctions improperly grant relief to non-parties and prevent the executive branch from taking steps to implement the Executive Order, the Solicitor General asked the Supreme Court to stay the preliminary injunction in this case "in full—or, if the Court concludes that the state respondents are proper parties, except as to individuals who are born or reside in those States."

On March 14, 2025, the same coalition of members of Congress that filed an amicus brief in the district court filed another amicus brief in the Supreme Court supporting the government's application for stays in these three cases.
