This case challenges Columbia University and Barnard College for allegedly unlawfully permitting, enabling, and failing to prevent pervasive antisemitism on their campus, particularly in the aftermath of the October 7 attacks, in violation of federal and state law. Other cases involving universities’ responses to speech and activity concerning Israel and Palestine, including matters involving antisemitism and/or anti-Palestinian expression, can be found here

On February 21, 2024, Students Against Anti-Semitism (SAA), StandWithUs Center for Legal Justice (SCLJ), five individual Jewish students at Columbia University, and other SCLJ members filed this lawsuit in the U.S District Court for the Southern District of New York against the Trustees of Columbia University and the Trustees of Barnard College. Plaintiffs asserted claims under Title VI of the Civil Rights Act of 1964, New York Executive Law § 296, New York Civil Rights Law § 40-c, New York City Admin. Code § 8-107(4), New York General Business Law §§ 349, 350, and for breach of contract. They sought injunctive relief, damages, statutory penalties, and attorneys’ fees. The case was assigned to Judge Vernon S. Broderick.

Plaintiffs filed an amended complaint on June 17, 2024. The revised complaint maintained the original legal claims and theories but added a new claim under 42 U.S.C. § 1986 and a premises liability claim, added numerous plaintiffs, expanded the factual record to include post-filing events, and updated information regarding several plaintiffs’ statuses.

On February 3, 2024, Columbia University requested that this case be designated as related to Forrest v. Trustees of Columbia University, No. 1:24-cv-01034-JPO (S.D.N.Y.). On February 28, 2024, the Court denied the request, but ordered that the same magistrate judge will oversee early pre-trial processes for both matters. On April 29, defendants requested that this case be designated as related to three additional cases: Forrest; John Doe v. Columbia University, No. 1:24-cv-02870 (JMF) (S.D.N.Y.); and C.S. v. The Trustees of Columbia University in the City of New York, No. 1:24-cv-03232 (AT) (S.D.N.Y.). This request was also denied.

Columbia University and Barnard College filed separate Motions to Dismiss on July 22, 2024. Columbia University asserted that plaintiffs (i) fail to state a claim under Title VI and 42 U.S.C. § 1986, (ii) fail to state any viable state-law claims, and (iii) that much of the suit is nonjusticiable because the organizational plaintiffs lack standing entirely, the individual plaintiffs lack standing to seek injunctive relief, and the requested injunction is impermissibly broad. Barnard College alleged that (i) the organizational plaintiffs lack standing, (ii) the suit is unripe, (iii) plaintiffs fail to state a Title VI claim because the amended complaint itself shows Barnard’s robust response to antisemitism and does not plausibly allege deliberate indifference or direct discrimination, (iv) plaintiffs fail to state any of their remaining state and federal claims, and (v) seek improper and unauthorized remedies that should be stricken.

On July 8, 2025, the Plaintiffs filed a Notice of Voluntary Dismissal with prejudice for their claim against Barnard College, following the parties' settlement agreement. As part of the settlement, Barnard College agreed to strengthen its anti-discrimination policies, require all students, faculty, and staff to complete training specifically addressing antisemitism, expand access to courses at the Jewish Theological Seminary, and implement strict guidelines for campus demonstrations. On September 12, 2025, the court denied Barnard College’s Motion to Dismiss, ruling that the motion was now moot.

This case is ongoing with respect to Plaintiffs’ claims against Columbia University.
