This case challenges Columbia University and its employees for allegedly resisting and begrudgingly granting a Jewish student's Sabbath accommodations, failing to protect her from antisemitism, and retaliating against her, in violation of federal and state laws. Other cases involving universities’ responses to speech and activity concerning Israel and Palestine, including matters involving antisemitism and/or anti-Palestinian expression, can be found here.

On February 2, 2024, a Jewish student at the Columbia School of Social Work (CSSW) filed this lawsuit in the U.S. District Court for the Southern District of New York against the Trustees of Columbia (Columbia), then–University President Minouche Shafik, and School of Social Work professors André Ivanoff and Elizabeth Creel. The plaintiff brought claims under Title VI of the Civil Rights Act of 1964, New York Executive Law § 296, New York Civil Rights Law § 40-c, New York General Business Law §§ 349, 350, and breach of contract. The plaintiff sought injunctive relief, damages, and attorneys’ fees. The case was initially assigned to Judge J. Paul Oetken, and later reassigned to Judge Margaret M. Garnett.

In her complaint, the plaintiff alleged that Columbia and its employees violated federal and state anti-discrimination laws designed to protect Jewish individuals from discrimination and retaliation. She asserted that her request for Sabbath observance accommodations in CSSW’s Dialectical Behavior Therapy (DBT) Program was met with significant resistance, and ultimately was granted only grudgingly. The complaint further claimed that the defendants disregarded her legitimate concerns about a hostile, antisemitic environment on campus, denied her request for a reasonable accommodation to address the risk of harm she experienced as a Jewish individual, and subsequently retaliated against her for reporting these issues and seeking accommodations (including by fabricating academic allegations to force her out of a specialized program).

On February 3, 2024, Columbia requested that this matter and Students Against Antisemitism, Inc. v. Trustees of Columbia University (No. 1:24-cv-01306) be designated as related cases. On February 28, 2024, the court denied that request, but ordered that the same magistrate judge would oversee early pretrial proceedings for both matters. On April 29, Columbia again sought to have this case designated as related to Students Against Antisemitism, Inc., as well as to John Doe v. Columbia University (No. 1:24-cv-02870) and C.S. v. The Trustees of Columbia University in the City of New York (No. 1:24-cv-03232). This request was also denied.

The plaintiff filed an amended complaint on November 11, 2024. The revised complaint, among other changes, parsed the Title VI claim into three distinct claims (direct discrimination, hostile educational environment, and retaliation), removed the request for injunctive relief, and expanded the factual record.

On May 29, 2025, the court was informed that the parties had reached a settlement agreement. According to the Columbia Spectator, Ziporah Reich, director of litigation at the Lawfare Project, stated that the parties “reached a confidential settlement with Columbia that includes a monetary component as well as other relief.” The plaintiff filed a notice of voluntary dismissal on June 12, 2025, which the court signed on June 16, 2025.

This case is now closed.
