On February 17, 2025, 11 plaintiffs filed this lawsuit against the ODNI, the CIA, the Director of National Security, and the Director of the CIA in the United States District Court for the Eastern District of Virginia. (The number of plaintiffs later increased to 19 in an amended complaint filed February 24, 2025). The case was assigned to District Judge Anthony J. Trenga. In their complaint, the plaintiffs alleged that the defendants planned to imminently fire the plaintiffs in violation of the Administrative Procedure Act (APA), the Administrative Leave Act (ALA), the First Amendment, and the Fifth Amendment. The plaintiffs claimed that their positions, which involved temporary DEIA assignments, were not within the category of DEI positions that EO 14151 sought to eliminate, and thus, the plan to fire them was an unlawful abuse of discretion. The plaintiffs alleged that their suspension and imminent termination violated the ALA by exceeding the permissible number of days that an agency may place an employee on leave and failing to satisfy any of the conditions under which the duration of the leave may be extended. The plaintiffs also alleged that the termination plan was based on an assumption about their beliefs on domestic matters; thus, it was irrelevant to their jobs in foreign intelligence and a violation of their right to freedom of speech under the First Amendment. Finally, they alleged that the defendants’ termination plan deprived them of a property interest in their jobs, and therefore, violated the Fifth Amendment’s due process guarantee because the plan lacked sufficient notice, the opportunity for a hearing, and any evidence. Represented by a law firm, Fluet, the plaintiffs sought injunctive relief, attorneys fees, expenses, costs, and any other pertinent relief. 

On the same day, February 17, the plaintiffs also filed a motion for a temporary restraining order (TRO). The court held an initial hearing on the motion on February 18, 2025, and an administrative stay was issued until further court order. During the administrative stay, the court ordered that the defendants must not terminate any of the plaintiffs or put them on unpaid leave; rather, the plaintiffs must stay on administrative leave with “full pay and benefits.”

On February 24, 2025, the plaintiffs filed an amended complaint that added eight plaintiffs—who, like the first eleven plaintiffs, were also nonpartisan civil servants in national security roles. The amended complaint added an explicit request for injunctive relief under the First and Fifth Amendments to the Constitution in addition or in the alternative to the request for injunctive relief under the APA that the plaintiffs had already sought in their first complaint and reiterated in their amended complaint. 

The hearing on the plaintiffs' request for a TRO continued on February 24 and February 27, 2025. Ultimately, the district court treated the plaintiffs' motion for a TRO as a motion for a preliminary injunction and denied it (and lifted the administrative stay). However, the court ordered that the plaintiffs be given until at least March 3, 2025 to make a decision about the deferred resignation program and other employment options that the CIA Director presented to the plaintiffs in a February 18, 2025 memorandum. 

On March 25, 2025, the court approved, with amendments, the parties' joint discovery plan and issued a scheduling order that set July 11, 2025 as the deadline for conclusion of discovery and July 17 for final pretrial conference. 

On March 27, 2025, the plaintiffs filed a motion for preliminary injunction (PI) in response to which the defendants filed an opposition on March 31. On March 31, the court heard the PI motion and granted it in part and denied in part. In its accompanying order, the court: (1) enjoined the defendants from terminating the plaintiffs without court approval; (2) mandated that the defendants allow the plaintiffs to appeal pursuant to CIA regulations any termination decisions made against them; (3) required the defendants to consider any requests from the plaintiffs for reassignment to open positions pursuant to CIA regulations and without regard to the definition of "competitive area" in a January 24, 2025 OPM memorandum; and (4) found that the plaintiffs did not need to post a bond.

This case is ongoing.

ORDERED that Plaintiffs' Renewed Motion for a Preliminary Injunction [Doc. No. 32] be, and the same hereby is, GRANTED in part, as set forth herein, and is otherwise DENIED; and it is further ORDERED that Defendants, and any of Defendants' officers, agents, servants, employees, and attorneys, as well as other persons who are acting in concert with them, be, and the same hereby are, ENJOINED from effectuating or implementing any decision to terminate the Plaintiffs without further Court authorization. To the extent that any such decision to terminate any Plaintiff is submitted to the Court for approval, the Court will assess the extent to which any such Plaintiff has received the appeal and consideration for reassignment he or she was entitled to receive as set forth on the record during the hearing; and Plaintiffs shall continue to remain on administrative leave with pay and benefits, or be otherwise reinstated, pending further Court order; and it is further ORDERED that Defendants provide Plaintiffs a requested appeal from any decision to terminate him or her, consistent with the steps set forth in CIA Regulation 4-16, including to permit Plaintiffs to submit "written comments" explaining why they should not be terminated, to provide Plaintiffs with a written notification of the Directors decision, and to provide reasonable notice of the status of any pending appeal. See [Doc. No. 14-1] § II. E. (Appeal of Termination Decision); and it is further ORDERED that Defendants consider any Plaintiffs' request for reassignment for open or available positions, in accordance with their qualifications and skills, without regard to the definition of a "competitive area" in the January 24, 2025 OPM Memorandum, and consistent with CIA Regulation 4-16 Section II. C. 4., including an Agency-wide review of available positions that Plaintiffs may be qualified for, notwithstanding any election that a Plaintiff may have made in response to the requirement that each Plaintiff select whether to retire, resign, or be terminated; and it is further ORDERED this Order shall issue and be in full force and effect, with the Court finding that, under the circumstances of this case, the posting of a bond by Plaintiffs is not necessary or proper.
