This case challenged the legality of the U.S. Department of Education Office of Civil Rights’ February 14, 2025 Dear Colleague Letter that advised educational institutions receiving federal funding to, among other things, stop teaching about systemic racism and race-related topics and ban all programming that supports Diversity, Equity, and Inclusion (DEI). Otherwise, they risked being deemed, or reported as, non-compliant and losing federal funding. On February 25, 2025, the American Federation of Teachers (AFT), the American Sociological Association (ASA), and the American Federation of Teachers-Maryland (AFT-Maryland) filed this lawsuit in the United States District Court for the District of Maryland, Baltimore Division. The plaintiffs sued the U.S. Department of Education (ED), the acting ED Secretary, and the Acting Assistant Secretary of ED’s Office for Civil Rights (OCR). 

The following week, on March 5, the plaintiffs filed a motion for leave to file excess pages and filed an amended complaint that added the Eugene School District as a plaintiff and replaced the Acting ED Secretary with the ED Secretary as one of the defendants. Represented by Democracy Forward, the plaintiffs sued the defendants under the Administrative Procedure Act (APA). The plaintiffs alleged that the Dear Colleague Letter violated the First Amendment by impermissibly restricting free speech, free expression, and free association based on content and viewpoint; Fifth Amendment due process for being unconstitutionally vague; and the APA for being an unlawful final agency action. For relief, the plaintiffs asked the court to declare the Dear Colleague Letter unlawful and unconstitutional, to set the letter aside, to issue a preliminary injunction against enforcement of the letter, attorney’s fees, and any other appropriate relief. The case was assigned to District Judge Stephanie A. Gallagher.

On March 6, 2025, the judge ordered the plaintiffs to show cause as to why their case should be heard in Maryland—explaining that Maryland might not be the appropriate venue given convenience and the absence of facts alleging harm in Maryland. The plaintiffs responded on March 12, stating that Maryland was a proper venue because AFT-Maryland, one of the plaintiffs, has 18,000 members who immediately began suffering harm in Maryland as a result of the Dear Colleague Letter. However, the plaintiffs said they would not object to a transfer of the case to the District of Columbia if the court determined that transfer would best serve “the interests of justice.” The next day, the defendants filed their own response claiming improper venue and calling for a transfer of the case.

On March 19, 2025, the plaintiffs filed a motion for miscellaneous relief, requesting that the court set a status conference to address two pending issues in the case—(1) their motion to file an enlarged amended complaint and (2) the question of venue—or, in the alternative, enter the requested relief in the docket. On March 20, Judge Gallagher granted the plaintiffs' motion for leave to file excess pages. On March 24, the court denied the plaintiffs' motion for miscellaneous relief—declining to hold a conference and stating that the court would consider the convenience of the forum when reviewing arguments in the forthcoming motion for preliminary injunction.

On March 28, 2025, the plaintiffs filed a motion for preliminary injunction. In their motion for preliminary judgment, the plaintiffs asked the court to enjoin the defendants from conducting any investigations, assessments, or federal funding pauses or cuts based on the defendants' February 28 Dear Colleague Letter and subsequent February 28  document “Frequently Asked Questions About Racial Preferences and Stereotypes Under Title VI of the Civil Rights Act." The plaintiffs also asked the court to: prohibit the defendants from reissuing the Letter under a different name; order the defendants to inactivate and remove the "End DEI Portal" on the Department of Education website; require the defendants to follow the Department's guidance under other, specific documents if the defendants commenced any investigation of alleged discrimination; and order the defendants to restore access to Title VI guidance materials that were removed from the Department of Education's website after January 20, 2025. The same day, the plaintiffs filed a consent motion for leave to file excess pages in their memorandum supporting their motion for preliminary injunction, which the court granted on April 1. 

On April 9, the plaintiffs filed a motion for preliminary injunction of certification and stay of final agency action under the APA (5 U.S.C. § 705). In the motion, the plaintiffs asked the court for preliminary injunctions—(1) ordering the defendants to suspend "the deadline for state education agencies and local education agencies to respond to the Reminder of Legal Obligations Undertaken In Exchange for Receiving Federal Financial Assistance and Request for Certification under Title VI and SFFA v. Harvard, dated April 3, 2025 (the 'Certification' )"; (2) enjoining the defendants from commencing any investigations, assessments, or funding cuts/freezes based on the Certification; (3) enjoining the defendants from reviving the Certification under a different name; (4) "ordering any signed Certifications null and void until further order of the Court;" and (5) requiring the defendants to "notify all state education agencies of the preliminary injunction as soon as is possible and prior to April 24, 2025." The plaintiffs also moved to file excess pages on April 9. 

On April 14, 2025, the defendants filed an opposition to the plaintiffs' two motions for preliminary injunction. The defendants also filed a consent motion for leave to file excess pages on the same day, which the court granted. On April 17, the plaintiffs filed their reply to the defendants' opposition and sought leave of the court to file excess pages (which the court granted).

On April 18, 2025, the court heard the plaintiffs two motions for preliminary injunction. In the days after the hearing, the plaintiffs filed a response in support of its motions and the defendants filed a response regarding the hearing and questions posed by the court. 

This case is ongoing.
