The Democratic National Committee ("DNC"), the Democratic Senatorial Campaign Committee ("DSCC"), and the Democratic Congressional Campaign Committee ("DCCC") sued President Donald Trump, the Attorney General, the FEC, and its Commissioners. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief, arguing that Executive Order 14215 unlawfully undermined the independence of the FEC and violated FECA.

The plaintiffs contended that this executive order gave the President and Attorney General unilateral authority to interpret and enforce federal election laws, effectively stripping the bipartisan FEC of its independent decision-making powers. The lawsuit challenged the order’s constitutionality, arguing that it endangered the neutrality of campaign finance regulation by allowing the President to dictate legal interpretations that could disadvantage political opponents.

The FEC was created in 1974 as an independent agency to administer and enforce FECA. It was designed to be bipartisan, with six commissioners, no more than three from the same political party, requiring at least four votes for key decisions. This structure aimed to ensure fair, neutral enforcement of federal election laws, free from partisan influence.

On February 18, 2025, President Trump issued Executive Order 14215, which declared that all executive branch employees must follow the President and Attorney General’s legal interpretations. The order explicitly prohibited any agency, including the FEC, from advancing a legal position contrary to the President’s view, undermining the Commission’s ability to function independently.

The plaintiffs argued that Executive Order 14215 directly conflicted with FECA’s statutory framework and violated fundamental constitutional principles of agency independence, citing Supreme Court precedents such as Humphrey’s Executor v. United States, 295 U.S. 602 (1935), and Morrison v. Olson, 487 U.S. 654 (1988). The lawsuit sought a declaration that FECA’s provisions guaranteeing FEC independence were constitutional and that the executive order could not be applied to the FEC.

Additionally, the plaintiffs alleged immediate harm to their operations, as the order threatened their ability to receive impartial guidance from the FEC and defend themselves in election-related legal matters. They cited a pending FEC complaint against DSCC, alleging campaign finance violations, which could now be resolved under legal interpretations dictated by the President rather than bipartisan commissioners. 

The case was assigned to District Judge Amir H. Ali.
