This case challenged the United States Environmental Protection Agency’s (EPA) failure to produce records to the Environmental Defense Fund (EDF) before a statutory deadline. 

On March 3, 2025, the EDF filed this lawsuit in the U.S. District Court for the District of Columbia against the EPA. On January 20, 2025, President Donald Trump signed Executive Order 14154, titled "Unleashing American Energy," directing the EPA to reevaluate the 2009 "Endangerment Finding"—EPA's determination that greenhouse gases threatened public health and welfare and that motor-vehicle emissions contribute to greenhouse gas pollution. “To bring greater transparency regarding the new administration’s directive”, the EDF submitted a Freedom of Information Act (FOIA) request on January 29, 2025, seeking all correspondence and records of EPA transition team members and political appointees relating to the Endangerment Finding. The EPA informed the EDF that it would not produce documents until well after the statutory FOIA deadline; this lawsuit was the EDF’s response.

In-house counsel and Kaplan Kirsch LLP represented the EDF. The complaint sought declaratory and injunctive relief—specifically, an order requiring the EPA to produce all requested documents immediately—as well as attorney fees. District Judge Dabney L. Friedrich presided over the case. On April 3, 2025, the government filed its answer to the complaint. 

On July 31, 2025, the court issued a minute order instructing the EPA to release responsive records to the EDF, and the EPA did so on August 14, August 28, and September 11, 2025. The EPA also produced a supplemental document on January 12, 2026. The EDF was then satisfied that the EPA had fulfilled its FOIA obligations, and the parties stipulated to dismiss the case on April 21, 2026. The court dismissed the case without prejudice and closed it that same day.
