This case challenged the Trump Administration’s freezing of Congressionally appropriated funds to the plaintiff, Radio Free Europe/Radio Liberty (RFE/RL), a nonprofit journalism organization. The plaintiffs filed this lawsuit in the United States District Court for the District of Columbia, and Judge Royce C. Lamberth was appointed to the case. RFA sued the United States Agency for Global Media (USAGM) along with agency heads. The plaintiffs sought declaratory and injunctive relief, as well as a writ of mandamus, claiming that the defendants unlawfully withheld congressionally appropriated funds essential to RFA’s operations.

RFE/RL, a private nonprofit organization, was established by Congress to provide independent journalism, particularly in regions where press freedom is restricted. They received annual federal grants for decades, authorized by the International Broadcasting Act 22 U.S.C. § 6207(f), which mandates that USAGM provide annual grants to RFE/RL. In fiscal year 2024, Congress appropriated $142 million for RFE/RL. That funding was renewed through a series of continuing resolutions, most recently through the Full-Year Continuing Appropriations and Extensions Act, 2025 (Pub. L. No. 118-158), signed into law by President Trump on March 15, 2025.

The issue underlying this case arose when Trump then issued his “Continuing the Reduction of the Federal Bureaucracy” Executive Order (EO 14238) on March 14, 2025. This EO instructed agencies to eliminate all non-statutorily required functions. USAGM formally terminated its grant agreement with RFE/RL on March 15, 2025. The reason given for the termination was that RFA no longer aligned with agency priorities. 

RFE/RL filed its complaint on March 18, 2025, claiming the termination of their grant funds violated the Administrative Procedure Act (APA) for being arbitrary and capricious, was an abuse of discretion, was not in accordance with law, and exceeded the agency's statutory and constitutional authority. The plaintiffs also brought a claim under the Mandamus Act seeking to compel the defendants to perform their duty—release the appropriated funds—to the plaintiffs. Additionally, RFE/RL asserted the defendants violated the Separation of Powers, Appropriations Clause, the Spending Clause, the Presentment Clause, and the Take Care Clause of the U.S. Constitution. Finally, plaintiffs brought an Ultra Vires claim asserting the defendants acted outside of their statutory authority. RFE/RL requested the court to immediately issue a temporary restraining order and preliminary injunction, compel USAGM to disburse approximately $77 million in funding for the period March 1 through September 30, 2025, and declare the agency’s actions unlawful. 

On March 19, the plaintiffs filed a motion for a temporary restraining order (TRO) and a preliminary injunction to enjoin the defendants from impounding or otherwise interfering with RFL/RL’s congressionally appropriated funding. Defendants filed their motion in opposition to the TRO on March 21. They argued that (1) the court has no jurisdiction over the plaintiffs’ claim because requests of specific performance on federal grant agreements must be heard by a Court of Federal Claims, and (2) they failed to meet any of the four elements required to issue a TRO. In its response, plaintiffs challenge the defendant’s jurisdictional argument by asserting they brought more than simple money damages from a breach of contract, but rather statutory and constitutional claims.

On March 25, 2025, Judge Lamberth granted the TRO preventing the defendants from taking any steps to close the plaintiff’s grant funds. 

On March 26, 2025, the defendants filed a notice of withdrawal of grant termination following their issuance of a letter to the plaintiffs wherein they informed the plaintiffs that their grant funds were no longer terminated. They asked the court to find the plaintiff's motion for injunctive relief moot. Two days later the plaintiffs responded, asserting their claim was not moot because the defendants only issued partial monetary relief. Further, they argue that even though the defendants claim to have rescinded the March 15 letter terminating RFL/RL’s grant funding, this recession is without prejudice and “neither the rescission letter nor the short filing that accompanied it makes any mention of moving forward with timely disbursing RFE/RL’s funds as the law requires, nor does it provide confirmation that there is no legal impediment to RFE/RL using those funds.”

MINUTE ORDER: On Thursday, April 17, the Court will hold a hearing on the pending preliminary injunction motions in Widakuswara v. Lake, 25-cv-1015, and Abramowitz v. Lake, 25-cv-887. The hearing will begin at 11:30 AM in Courtroom 15. Plaintiffs will present their arguments first; the Court will break for lunch at 12:30 PM and will reconvene at 1:45 PM; and the government will present their argument once the Court reconvenes. Plaintiffs will be provided time to respond. Once the hearing concludes, the Court will take a brief recess. At that point, the Court will hold status conferences for each of the network grantee cases in which there is a pending motion for preliminary relief: RFE/RL v. Lake, 25-cv-799 (RCL); Radio Free Asia v. United States, 25-cv-907 (RCL); and Middle East Broadcasting Networks v. United States, 25-cv-966 (RCL). Counsel in each of the network grantee cases listed above is encouraged to attend the Widakuswara preliminary injunction hearing, given the interrelatedness of the relief sought in each case.
