This is a case about the participation of transgender athletes in college sports. On November 13, 2024, twelve student-athletes on the women's volleyball team at San Jose State University (SJSU) filed this lawsuit in the United States District Court for the District of Colorado challenging a collegiate athletic conference rule allowing transgender women to participate in women’s sports. In their suit, the students named the Mountain West Conference (MWC) and its Commissioner, the Board of Trustees of the California State University (CSU), and various officials at SJSU. The plaintiffs, represented by private counsel, sued under Title IX and 42 USC § 1983, alleging that defendants violated their rights under Title IX, the Equal Protection Clause, the Due Process Clause, and the First Amendment; they also brought state law claims that they later removed in an amended complaint. The plaintiffs sought monetary damages, a declaratory judgment, an injunction, and emergency injunctive relief in advance of a November 2024 MWC volleyball tournament. The case was assigned to U.S. District Court Judge S. Kato Crews. 

At the time of the lawsuit, the NCAA Transgender Policies, which member Conferences are bound by, allowed transgender women to play on women's sports teams if they had one year of testosterone suppression and measurements three times throughout the season. The complaint stated that in September 2024, MWC instituted an updated “Transgender Participation Policy” (TPP). According to the plaintiffs, the current policy stated that the decision to allow a transgender athlete to participate on a conference team is at the discretion of that student’s university, provided that they meet eligibility criteria and standards of the NCAA. Additionally, the policy specified that teams refusing to participate in a match due to the participation of transgender athletes on the opposing team will be considered to have forfeited the game.

The plaintiffs claimed that the NCAA and MWC policies violate Title IX because they permit transgender student athletes to compete in women’s matches. They also alleged that the defendants retaliated against a plaintiff, in violation of Title IX, for filing a complaint. Additionally, the complaint asserted that the TPP constituted sex discrimination, in violation of the Equal Protection Clause, by allowing transgender women to play on women's teams and by penalizing teams that refuse to play against teams with transgender athletes. Further, the plaintiffs alleged that allowing transgender women to access women's locker rooms violates the right to bodily privacy under the Fourteenth Amendment. Finally, the plaintiffs alleged that the MWC violated the First Amendment by penalizing teams that boycott matches against teams with transgender athletes and discouraging athletes and coaches from expressing disagreement with the participation of transgender athletes in women's sports. 

On November 19, 2024, Utah State University filed an intervenor complaint against the defendants. The institution also sought emergency declaratory and injunctive relief against MWC, alleging that the conference’s TPP violated Title IX. 

The court denied the plaintiffs' emergency motion for a preliminary injunction on November 25, 2024. The court noted that the conference has had a TPP in place since 2022, and that movants could have sought injunctive relief earlier if it was true that the “exigencies of the circumstances required mandatory court intervention.” In addition, the movants failed to meet their burden to show requisite irreparable harm or a likelihood of success on the merits according to the opinion. 2024 WL 4876221.

That same day, the plaintiffs filed an appeal to the Tenth Circuit. On November 26, 2024, the Tenth Circuit affirmed the lower court’s ruling, and agreed that granting the requested injunctive relief would be highly prejudicial to the defendants and that the plaintiffs had not established clear entitlement to relief. 

The plaintiffs also filed an amended class-action complaint on March 24, 2025, seeking to represent “MWC women’s volleyball student-athletes who competed in the MWC during one or more of the 2022, 2023 and/or 2024 seasons and/or who competed in the MWC on teams who were assigned forfeits during the 2024 season.” The case is ongoing as of April 2025.

Plaintiffs shall have 60 days to respond to Defendants' motions or to file an amended pleading, and may file a single opposition brief of no more than 55 pages.4. Defendants shall have 21 days after the date of service of such brief to file replies, which shall not exceed 15 pages each.The Court reminds the parties, "Motions to dismiss filed under Federal Rule of Civil Procedure 12(b) are discouraged if the defect is curable by the filing of an amended pleading. As such, parties are required to meet and confer prior to the filing of a motion to dismiss under Rule 12(b)....
