On March 13, 2025, eight students—filing under pseudonyms—brought this lawsuit in the U.S. District Court for the Southern District of New York, challenging efforts by Columbia University to comply with a congressional request for disciplinary records related to pro-Palestinian student protests. One of the student plaintiffs, Mahmoud Khalil, had been detained by the Department of Homeland Security (DHS) and purportedly had his green card revoked earlier that month. See Mahmoud Khalil v. Joyce. This case challenged both the congressional request and the universities’ willingness to comply with it, alleging First Amendment violations and breach of contract. The defendants included Columbia University, the Committee on Education and Workforce of the U.S. House of Representatives, the Attorney General, the Secretary of the Department of Education (ED), the head of the Department of Justice Taskforce to Combat Anti-Semitism, the Acting General Counsel of the U.S. Department of Health and Human Services (HHS), and the Federal Acquisition Service Commissioner of the General Services Administration (GSA). The case was assigned to Judge Arun Subramanian.

The plaintiffs sought to block the enforcement of a February 13, 2025, letter from the House Committee demanding that Columbia and Barnard turn over disciplinary records related to campus protests, many of which involved pro-Palestinian speech. The plaintiffs asserted that the letter is part of a coercive campaign to suppress student dissent, backed by threats to withhold federal funding from the universities. They argued that this “jawboning” tactic whereby the government coerces private actors into censoring speech violates the First Amendment. The complaint also alleged that Columbia and Barnard have breached contractual obligations to their students, particularly obligations regarding freedom of speech and academic freedom. 

They sought an injunction barring Congress from compelling the universities to provide student disciplinary records, an injunction from Columbia and Barnard from complying with the Feb. 13 Letter, as to documents not already produced, and a declaratory judgment.

On March 20, 2025, the court issued an order enjoining the defendants from "1) providing, directly or indirectly, the records outlined at Dkt. 15-1 at 6 to Congress or any federal agency; and 2) releasing the names or any other identifying information of any student included in the records outlined at Dkt. 15-1 at 6." 

On April 4, 2025, the court denied without prejudice the plaintiffs' motion for a temporary restraining order that would prohibit the government from terminating Columbia’s funding and block Columbia from turning over any student records to Congress or taking steps it had announced to combat antisemitism on campus. The court explained that plaintiffs failed to address threshold requirements they need to satisfy to obtain such relief, including issues related to standing and irreparable harm, and that they could renew their motion if they addressed these issues. Furthermore, the court vacated the temporary injunction that prevented Columbia from providing the student records to Congress or federal agencies or releasing the student names or identifying information. Accordingly, the court instructed the defendants: "At least thirty days before furnishing to Congress any student records, or students’ identities in records already produced, the Columbia Defendants must advise the plaintiffs and Court of their intended production." 

On April 8, 2025, defendants' counsel addressed a letter to Judge Subramanian informing the court that Columbia was planning to provide responses to inquiries from the U.S. Senate Committee on Health, Education, Labor and Pensions and the U.S. House Committee. Counsel stated that they were giving this notice to the court "out of an abundance of caution," but that because the information Columbia would provide to Congress would "not include any student records, nor furnish any students’ identities in records already produced," it was Columbia's understanding that the responses were outside the court's order and did not trigger the 30-day notice requirement.

Counsel for plaintiffs, however, argued that the information fell within the 30-day notice requirement because the "requests call for student record information on their face" and "the potential answers to the inquiries could require information regarding students’ and Plaintiffs’ associations and memberships, both of which are part and parcel of students’ records." 

The court ordered that Columbia provide notice to plaintiffs and the court of what the university intended to disclose to Congress by 5 pm on April 9 and to hold off on producing those documents until 5 pm on Friday, April 11, 2025. On April 11, Judge Subramanian denied the plaintiffs' request that the court require Columbia to give 30 days notice regarding its response to the Senate Committee's request.

On April 18, the plaintiffs filed a second amended complaint, which added Claire Shipman, Interim President of Columbia and Co-Chair of the Trustees of Columbia University, as a defendant.

This case is ongoing.
