The plaintiffs, a group of organizations that relied on the Foundation’s funding, argued that the administration's actions were a violation of the separation of powers, the Appropriations Clause, the Spending Clause, the Presentment Clause, and the Take Care Clause of the Constitution. They also argued that the purported appointment of Peter Marocco as Acting Chair of the Foundation's Board violated the Federal Vacancies Reform Act of 1998 and the Appointments Clause. The Plaintiffs sought injunctive and compensatory relief.
