This case challenged the Trump administration’s authority to dismantle the U.S. Department of Education (“DOE”). On March 24, 2025, the National Association for the Advancement of Colored People (“NAACP”), three regional NAACP branches, three teachers’ unions, and three parents of children who benefit from DOE programs filed this lawsuit in the U.S. District Court for the District of Maryland against the United States and the DOE. Represented by private counsel, the Education Law Center, the National Education Association, and the National Student Legal Defense Network, the plaintiffs alleged that the Trump administration's efforts to dismantle and eliminate the DOE, including the cancellations of grants, reductions of force, and a March 20, 2025 Executive Order issued by President Trump, violated the Take Care Clause (Art. II § 3), the Appropriations Clause (Art. I § 9), the Spending Clause (Art. I § 8), the Separation of Powers, and the Administrative Procedure Act. The plaintiffs sought a preliminary and permanent injunction, a declaration that the defendants’ actions were unlawful, and attorneys’ fees and costs.

The case was assigned to District Judge Julie R. Rubin, who ordered that the defendants file a response to the complaint on June 26. After the deadline was extended to July 28, the plaintiffs filed an amended complaint and motion for a preliminary injunction on July 1. The amended complaint added no different parties, but did add additional and more specific details on various sub-agencies within DOE and the losses they suffered in the reduction in force. The amended complaint also added factual developments after the original complaint was filed, such as the withholding of nearly $6.8 billion in funding for certain mandatory grant programs. Finally, the amended complaint also added additional detail on how the funding and workforce cuts will prevent the DOE from carrying out its mandatory functions. 

In their motion for a preliminary injunction, the plaintiffs argued that they were likely to succeed on their claims that the defendants had acted ultra vires and in violation of the APA. While the DOE was established by Congress through statute, there was no statute empowering the President to dismantle the agency at will. "In the absence of legislation authorizing a closure, any concrete steps to implement a closure necessarily are inconsistent with applicable law." And, even if the actions were considered separately, rather than in sum, the plaintiffs argued that they were individually ultra vires, since they prevented the sub-agencies from performing their statutory duties. As for the APA, the plaintiffs argued that the defendants' actions were contrary to law for the same reasons as they were ultra vires. Finally, the plaintiffs claimed the dismantling of DOE was arbitrary and capricious because "Secretary McMahon has stated publicly that she wishes to implement the President’s vision of abolishing the Department, but that provides no adequate justification for shuttering a Cabinet agency that Congress has created, has vested with mandatory statutory responsibilities, and has regularly funded." Therefore, the plaintiffs asked for a preliminary injunction enjoining the defendants from taking any other actions to dismantle the DOE. 

The defendants' reply to the plaintiffs' motion was due July 25. The court also scheduled a hearing on the plaintiffs' motion for August 15.
