On March 25, 2025, Turkish national and Tufts University student Rümeysa Öztürk was abruptly detained by masked plainclothes agents of the Department of Homeland Security (DHS) on the streets of Somerville, Massachusetts. The federal government revoked Öztürk’s F-1 student visa and detained her without notice in response to a 2024 op-ed she co-authored in a student newspaper criticizing Tufts’ response to the pro-Palestinian movement. Footage capturing Öztürk’s public arrest quickly went viral. 

First Habeas Petition in Massachusetts

Öztürk filed a petition for a writ of habeas corpus in the U.S. District Court for the District of Massachusetts the same day she was arrested, arguing that her detention violated her First Amendment right to free speech and her Fifth Amendment right to due process. Represented by the ACLU, Öztürk also sought bail pending adjudication of her petition and alleged that the government’s policy of targeting non-citizens for removal based on First Amendment-protected speech violated the Administrative Procedure Act (“APA”). She named as respondents President Donald Trump, U.S. Immigration and Customs Enforcement (“ICE”), DHS, and the U.S. Department of State. 

District Judge Indira Talwani ordered that Öztürk not be moved outside of Massachusetts, but by the time that order was entered on March 25, Öztürk had already been moved to an ICE detention facility in Vermont, soon to be transferred to Louisiana. On March 28, District Judge Denise Casper ordered that Öztürk not be moved outside of the United States while the Court resolved whether it had jurisdiction to decide the habeas petition. In response, the government respondents argued that the petition should be dismissed for lack of jurisdiction or, in the alternative, transferred to the Western District of Louisiana, where Öztürk was presently detained. In response, Öztürk argued that jurisdiction was proper in Massachusetts or, alternatively, that jurisdiction lay in the District of Vermont, where she was detained at the time of the filing of her habeas petition. On April 4, Judge Casper ordered the matter transferred to the District of Vermont, because it was the only other court where the petition could have been brought at the time of filing. The court kept in place the order not to remove Öztürk from the U.S. and left it to the District of Vermont to determine if it retained jurisdiction over the matter given Öztürk’s transfer to Louisiana.

Second Habeas Petition in Vermont

The case was then transferred to the U.S. District Court for the District of Vermont and assigned to District Judge William Sessions. At an April 7 status conference, Judge Sessions ordered the parties to submit supplemental briefs on the jurisdictional issue by April 10. In her brief, Öztürk sought bail pending adjudication and in the alternative moved for her return to Vermont. A hearing was set for April 14. The government respondents argued that the Vermont court lacked jurisdiction and that the only proper venue was the Western District of Louisiana. Judge Sessions ordered Öztürk returned to Vermont from ICE custody in Louisiana on April 18, finding that the case had been properly transferred to the District of Vermont. 

Appeal to the First Circuit

The government immediately appealed the order to transfer Öztürk to Vermont, and on April 28, the U.S. Court of Appeals for the First Circuit entered an emergency stay of the transfer order pending a hearing set for May 6, 2025. The day after that hearing, however, the First Circuit denied the stay and ordered the government to comply with the district court’s transfer order within one week. On May 18, defendant-appellants petitioned for rehearing en banc.  

Release from Custody

Back in the District Court, on May 9, Judge Sessions held a hearing on Öztürk’s motion for bail pending adjudication and ordered the government to release Öztürk immediately. Öztürk was released from custody that day.  

According to observers at the bail hearing, the court concluded that Öztürk raised “a very substantial First Amendment claim” in her underlying habeas challenge, in addition to a “substantial claim” that the Trump administration violated her due process rights. The Trump administration did not offer any witnesses in response, and provided no basis for its decision to revoke Öztürk’s visa and arrest her in order to hold proceedings aimed at deporting her. Judge Sessions found no risk of flight or danger to public safety. The court ordered the government to propose conditions of release by May 12, and the court issued final conditions on May 16.

The court held a status conference on May 15 where it ordered Öztürk to file a discovery motion within 30 days. The following day, defendants' request for additional conditions of release were granted in part and denied in part. The court ordered Öztürk to comply with ICE and immigration court directives, complete mandatory check-ins, report address and travel changes, avoid criminal activity, and assist with removal if ordered. Any re-detention required 48 hours' notice to the court and her counsel. 

On May 23, 2025, plaintiffs filed a motion for preliminary injunctive relief restoring Öztürk's Student Exchange and Visitor Information Systems (SEVIS) record, which had been terminated by ICE on March 25 following her detention. On June 2, defendants filed a motion to dismiss the SEVIS claim for improper venue and lack of jurisdiction; alongside briefing that motion, plaintiffs have also moved for discovery. 

The case is ongoing, but as of this writing, Öztürk is free from custody and in Massachusetts.
