On March 27, 2025, the plaintiff filed this lawsuit in the U.S. District Court for the District of Columbia against the United States, the U.S. Agency for Global Media (USAGM), the Office of Management and Budget (OMB), the Department of the Treasury, and several officials in their official capacities. The plaintiff sought declaratory and injunctive relief, as well as a writ of mandamus, claiming that defendants unlawfully withheld funds explicitly appropriated by Congress and essential to RFA’s continued operations.

This case was assigned to Judge Royce C. Lamberth.

The plaintiff alleged that on March 15, 2025, USAGM abruptly terminated its grant agreement, citing a new Executive Order (EO) from President Trump titled “Continuing the Reduction of the Federal Bureaucracy.” (Exec. Order No. 14-238). The plaintiff argued that the EO could not override statutory mandates and that USAGM’s decision violated the Administrative Procedure Act (APA), exceeded statutory and constitutional authority, and infringed multiple constitutional provisions. The plaintiff sought emergency relief, asserting that it was forced to furlough 75% of its domestic staff and suspend most of its operations because of the funding freeze. Additionally, the plaintiff asserted the defendants violated the Separation of Powers, Appropriations Clause, the Spending Clause, the Presentment Clause, and the Take Care Clause of the U.S. Constitution.

On the same day plaintiffs filed their complaint, they filed a notice of two related cases, Open Technology Fund v. Lake (1:25-cv-00840) and RFE/RL, Inc. v. Lake (1:25-cv-00799). 

On March 28, 2025, plaintiffs filed a motion for a temporary restraining order (TRO) that requested that the Court stop the defendants from impounding or interfering with RFA’s congressionally appropriated funding. On April 10, the parties agreed to convert the TRO motion into a preliminary injunction (PI) request. That same day, the defendants filed their motion in opposition and argued they did have statutory authority to terminate funds, and any dispute over the execution of funds was contractual in nature, removing jurisdiction from the District of Columbia.

On April 25, 2025, the court issued a PI requiring the government to restore fiscal year 2025 funding to RFA and, in a related case, the Middle East Broadcasting Network. The court found the plaintiff was likely to succeed on the merits and faced irreparable harm absent relief.

The government appealed the injunction to the D.C. Circuit, arguing that the district court lacked jurisdiction under the Tucker Act and that the claim should have been brought in the Court of Federal Claims. On May 3, 2025, a motions panel of the D.C. Circuit stayed the injunction pending appeal, signaling agreement with the jurisdictional argument.

The plaintiff then sought en banc review, and on May 28, 2025, the D.C. Circuit sitting en banc vacated the stay and reinstated the preliminary injunction. The court held that the government had not made a strong showing of likely success on the merits and emphasized the imminent risk of collapse facing the plaintiff organizations. The court also determined that the government’s harm—potential inability to recover funds—was outweighed by the irreparable injury to plaintiff’s operations.

As of June 2025, USAGM had disbursed the April and May 2025 funds to RFA in compliance with the district court’s order.

The case remained ongoing on an expedited appellate schedule.

MINUTE ORDER: On Thursday, April 17, the Court will hold a hearing on the pending preliminary injunction motions in Widakuswara v. Lake, 25-cv-1015, and Abramowitz v. Lake, 25-cv-887. The hearing will begin at 11:30 AM in Courtroom 15. Plaintiffs will present their arguments first; the Court will break for lunch at 12:30 PM and will reconvene at 1:45 PM; and the government will present their argument once the Court reconvenes. Plaintiffs will be provided time to respond. Once the hearing concludes, the Court will take a brief recess. At that point, the Court will hold status conferences for each of the network grantee cases in which there is a pending motion for preliminary relief: RFE/RL v. Lake, 25-cv-799 (RCL); Radio Free Asia v. United States, 25-cv-907 (RCL); and Middle East Broadcasting Networks v. United States, 25-cv-966 (RCL).
