This lawsuit is about a class action challenge to Idaho House Bill 83 (“H.B. 83”), which attempted to regulate illegal immigration.

On March 27, 2025, the Idaho Organization of Resource Councils, the Alliance of Idaho, and five named private plaintiffs brought suit in U.S. District Court for the District of Idaho against the Attorney General of the State of Idaho, and Prosecuting Attorneys for several Idaho counties.

Plaintiffs alleged that H.B. 83, which created two new state law offenses entitled “Illegal Entry from Foreign Nation” and “Illegal Reentry by Certain Aliens” (collectively, the “Immigration Cooperation and Enforcement Act”), was plainly illegal. The laws set forth in H.B. 83 criminalized unlawful entries and re-entries into the U.S. by non-U.S. citizens. While the laws did provide that there were affirmative defenses to protection, for instance if the U.S. had granted lawful status or had already granted asylum, but did not itself provide a defense for people currently seeking asylum or other protection. Plaintiffs challenged the premise of H.B. 83, which created a state system to regulate immigration separate from federal immigration processes, and argued that it was unconstitutionally vague, placing enormous power and discretion in the hands of state officials.

Plaintiffs noted that they sought to represent two classes: a class of non-citizens who may attempt to enter Idaho via a non-lawful entry and a class of noncitizens who may attempt to re-enter Idaho after they were denied admission, excluded, deported, or otherwise removed from the U.S. In its complaint, plaintiffs specifically alleged the following violations of law: (1) H.B. 83 violated the Supremacy Clause of the U.S. Constitution by attempting to pre-empt federal immigration law; (2) H.B. 83 further violated the Commerce Clause by impermissibly regulating movement across state and international borders, burdening interstate commerce; (3) Defendants violated the Due Process Clause of the Fourteenth Amendment, as H.B. 83 is impermissibly vague and overbroad, failing to provide fair notice of what is prohibited and therefore implicitly encouraging arbitrary enforcement. Plaintiffs sought declaratory and injunctive relief, to prevent the enforcement of H.B. 83’s entry and reentry provisions. Plaintiffs also filed an emergency motion to request a temporary restraining order, provisional class certification, and preliminary injunction to enjoin the enforcement of H.B. 83.

On the same day, the court issued its decision to grant plaintiffs’ motion ex parte, finding that the plaintiff had established the requisite basis for entry of a temporary restraining order. The court noted that other states, such as Iowa, Oklahoma, and Texas, had also attempted to create their own state-level immigration enforcement scheme, and that these prior state immigration schemes had been litigated in United States v. Iowa, 126 F.4th 1334, 1340-41 (8th Cir. 2025), United States v. Texas, 97 F.4th 268 (5th Cir. 2024), and United States v. Oklahoma, 739 F. Supp. 3d 985 (W.D. Okla. 2024). In each of these cases, courts had held that federal law likely preempts the state schemes. The court found that precedent persuasive, and also noted (1) that the plaintiffs could likely demonstrate irreparable harm if enforcement of the state law could proceed and (2) the balance of equities and public interest favor granting injunctive relief, as the state is unlikely to suffer injury from a temporary delay in enforcement. As such, the court held it appropriate to establish a temporary restraining order, to remain in effect for fourteen days until the court’s preliminary injunction hearing.

On April 22, the plaintiffs filed an amended complaint, adding all of the Prosecuting Attorneys of all Idaho counties as defendants. 

The preliminary injunction hearing was held on April 10, 2025. On April 28, the court granted the preliminary injunction, finding that the plaintiffs had a strong likelihood of the merits of the case, particularly their due process and preemption claims. As such, the court enjoined all defendants, including their officers, agents, employees, attorneys, and any person acting in concert or participation with them, from enforcing H.B. 83. 

In the same order, the court granted class certification. The court certified the following provisional classes: 1). The Entry Class, including all aliens who had entered the U.S. illegally; and 2).  The Reentry Class, including all aliens who had reentered the U.S. illegally. 

This case is ongoing.
