This case was filed on March 31, 2025, in the U.S. District Court for the District of Columbia, challenging an interim final rule (IFR) issued by the Department of Homeland Security (DHS). The IFR established a new, mandatory registration regime for noncitizens aged 14 and older who had been in the U.S. for at least 30 days but were not yet registered under the current system. The rule required them to submit personal information, fingerprints, and biometric data through a new online system. The rule also mandated that noncitizens carry proof of registration at all times, with penalties for noncompliance, including criminal prosecution. This case was assigned to Judge Trevor N. McFadden.

The plaintiffs included several immigrant advocacy organizations, such as the Coalition for Humane Immigrant Rights (CHIRLA), United Farm Workers (UFW), Make the Road New York (MRNY), and CASA. They argued that the IFR violated the Administrative Procedure Act (APA) by being implemented without the necessary notice-and-comment period, and that it was arbitrary and capricious, especially given its abrupt implementation and lack of explanation. The plaintiffs contended that the new registration system was inconsistent, confusing, and placed a disproportionate burden on vulnerable noncitizens, including those who did not speak English, lacked internet access, or were ineligible for any immigration benefits.

The plaintiffs sought to halt the enforcement of the IFR, arguing that it would cause irreparable harm to their members, who included undocumented individuals and those in mixed-status families. The plaintiffs asked for declaratory and injunctive relief. However, in an April 10, 2025 memorandum order, the court denied plaintiff's motion for a stay and preliminary injunction, because it determined that the plaintiffs lacked standing to bring the lawsuit. According to the memorandum order, they failed to show a concrete injury, and the harms they claimed were speculative. As a result, the court denied the motion for a stay and preliminary injunction, concluding that the plaintiffs were not likely to succeed on the merits of their claims.

Following the order, plaintiffs filed an appeal to the U.S. Court of Appeals for the D.C. Circuit on April 24, 2025. That same day, they filed a motion in the district court seeking an injunction pending appeal. On June 12, the district court denied the motion, finding that plaintiffs had failed to demonstrate irreparable harm in the absence of injunctive relief. 

The case is ongoing.
