In relevant part, EO 14248 seeks to make several changes to the rules governing elections. First, it directs the Election Assistance Committee (EAC) to alter the federal voter registration form prescribed by Congress ("Federal Form") to require documentary proof of United States citizenship. Second, it directs the EAC to change the Federal Form to require a state or local official to record on the form the type of documentary proof of U.S. citizenship that the voter provided. Third, it directs the EAC to take appropriate action to cease providing federal funds to states who do not comply with federal voting requirements, including the proof of citizenship requirement. Fourth, it directs the EAC to amend the Voluntary Voting System Guidelines (VVSG) 2.0 to prohibit the use of barcodes or "quick response" (QR) codes to encode votes, and require voting systems to provide a voter-verifiable paper record. Fifth, it directs the U.S. Attorney General to take all necessary action to enforce the federal statutes that establish a uniform election day for federal elections against states that include absentee or mail-in ballots received after election day in the final tabulation of votes. Finally, the EO directs the Secretary of Defense to update the Federal Post Card Application to require voters to provide documentary proof of citizenship and proof of eligibility to vote in the relevant state election.

As a result, on March 31, 2025, the plaintiffs--the Democratic National Committee, Democratic Governors Association, Democratic Senatorial Campaign Committee, Democratic Congressional Campaign Committee, and Democratic Minority Leaders of the United States House and Senate--brought this case in the U.S. District Court for the District of Columbia. They were represented by Elias Law Group. The lawsuit named President Donald Trump, the Executive Office of the President, the U.S. Election Assistance Commission, the U.S. Department of Justice, the U.S. DOGE Service, the U.S. Department of State, the U.S. Department of Homeland Security, the U.S. Department of Defense, the U.S. Department of Veterans Affairs, the U.S. Small Business Administration, the U.S. Department of the Interior, the U.S. Social Security Administration, and their agency heads as defendants. Seeking declaratory and injunctive relief along with attorneys’ fees, they alleged that by purporting to impose election rules on states, the President exceeded his constitutional powers and unlawfully infringed on congressional and state authority in violation of the Separation of Powers, the Administrative Procedure Act, Election Day Statutes, the National Voter Registration Act, the Uniformed and Overseas Citizens Absentee Voting Act, the Fifth Amendment, the First Amendment, the Privacy Act, and the Help America Vote Act.

The next day, the case was assigned to District Judge Colleen Kollar-Kotelly.

On April 3, 2025, Judge Kollar-Kotelly ordered that this case be consolidated with League of United Latin American Citizens v. Executive Office of the President (25-cv-00946) and League of Women Voters Education Fund v. Trump (25-cv-00955). League of United Latin American Citizens was named the lead case, and all further filings were directed to be filed there.
