In this case, a Florida business that imports Chinese goods challenged President Trump’s use of purported emergency powers to unilaterally impose tariffs on imports from China. Pursuant to the president's memorandum “America First Trade Policy," the government imposed a “global supplemental tariff” to address purported trade deficits on China, Canada, and Mexico. Less than two weeks later, Trump put a 10% tariff—additional to existing tariffs—on all Chinese imports in his February 1 Executive Order “Imposing Duties To Address the Synthetic Opioid Supply Chain in the People's Republic of China” (EO 14195). Just over a month later, Trump increased the additional tariff twofold, to 20%, in his March 3 Executive Order “Further Amendment to Duties Addressing the Synthetic Opioid Supply Chain in the People's Republic of China” (EO 14228). Trump claimed that the International Emergency Economic Powers Act (IEEPA) authorized his enactment of the tariffs. 

On April 3, 2025, a Florida business, Emily Ley Paper Inc. (doing business as “Simplified”) that imports from China filed this lawsuit in the United States District Court for the Northern District of Florida, Pensacola Division. Represented by public interest counsel (the New Civil Liberties Alliance) and private counsel (Creed & Gowdy, P.A.), the Plaintiff company sued Trump, the Executive Office of the President, the United States, the Department of Homeland Security (DHS) and its Secretary, and the U.S. Customs and Border Protection (CBP) and its Acting Commissioner. Bringing suit under the Administrative Procedure Act (APA), Plaintiff alleged that the tariffs inflicted economic and competitive harm, exceeded statutory authority, and violated the U.S. Constitution. The company alleged that the tariffs were not authorized under the IEEPA and the EOs were not “necessary” to address the purported emergency (but were instead aimed at decreasing the U.S. trade deficit and increasing federal revenue). Additionally, Plaintiff argued that if IEEPA can be construed to authorize the president’s enactment of the tariffs, then IEEPA is unconstitutional because it “transfers core legislative powers to the President by permitting him to set tariffs and regulate commerce with foreign nations” in violation of the nondelegation doctrine. Finally, Plaintiff contended that the tariff modifications to the Harmonized Tariff Schedule of the United States (HTSUS) that were made to comply with the EOs violated the APA. 

Plaintiff sought declaratory and injunctive relief, including enjoinment of the Defendants from implementing the EOs and resulting tariff modifications. They also sought attorneys’ fees. U.S. District Judge T. Kent Wetherell II was assigned to the case. 

On April 14, 2025, Defendants filed a motion to transfer the case to the Court of International Trade, claiming that the district court "lacks jurisdiction to entertain this challenge because Congress has vested the subject matter of this suit within the exclusive jurisdiction of the Court of International Trade." While that motion was pending, Plaintiffs filed an amended complaint on May 5, adding additional importers as plaintiffs and updating the claims.

On May 20, the court granted Defendants' motion to transfer the case to the Court of International Trade. On June 5, the government moved to stay the case pending resolution of cases already raising the same issues that are on appeal to the Federal Circuit in V.O.S. Selections, Inc. v. Trump and Oregon v. TrumpOn June 16, the court issued such a stay, holding the case until a "final, unappealing decision" in V.O.S. Selections comes down. On June 24, Plaintiffs filed a motion to reconsider the stay. 

The case is ongoing.
