The Plaintiffs in this case were long-term care facilities and associations of long-term care providers—American Health Care Association, Texas Health Care Association, Arbrook Plaza, Booker Hospital District, and Harbor Lakes Nursing & Rehabilitation Center. They filed this lawsuit on May 23, 2024 in the U.S. District Court for the Northern District of Texas, naming the U.S. Department of Health and Human Services (HHS) and its Secretary and Centers for Medicare and Medicaid Services (CMS) and its Administrator as Defendants. Represented by private counsel, the Plaintiffs argued that the standards imposed under the Final Rule were impossible to meet and would ultimately harm thousands of nursing homes the residents they served. They alleged that the Final Rule exceeded Defendants’ statutory authority in violation of the Administrative Procedure Act. They sought attorneys’ fees, declaratory relief, and injunctive relief, asking the court to issue an order vacating both the 24/7 RN requirement and the HPRD requirement. The case was assigned to District Judge Matthew Joseph Kacsmaryk and Magistrate Judge Lee Ann Reno.

On June 18, 2024, the Plaintiffs filed an amended complaint adding LeadingAge, a membership organization of nonprofit aging service providers, as a Plaintiff. The state of Texas filed a substantively identical lawsuit against the same Defendants on August 14, State of Texas v. U.S. Department of Health and Human Services (2:24-cv-00171). On September 18, the Court ordered that the cases be consolidated, and the state of Texas joined this lawsuit as a Plaintiff.

The Plaintiffs filed a joint motion for summary judgment on October 18, 2024, and the Defendants filed a cross motion for summary judgment on November 15, 2024. Following a series of motions, responses, and amicus briefs, Judge Kacsmaryk ruled in favor of Plaintiffs. On April 7, 2025, the Court issued an opinion granting Plaintiffs’ motion for summary judgment and denying Defendants’ cross motion. 777 F.Supp.3d 691. The Court found that both the 24/7 RN and HPRD requirements exceeded Defendants’ statutory authority. Specifically, the Court found that the Final Rule imposed requirements inconsistent with the Nursing Facility Reform Law enacted by Congress in 1987. The Reform Law in part required a registered nurse to be on site for only eight hours per day, and required nursing facilities to consider residents’ individualized needs when determining other staffing, which the Court found to be inconsistent with the strict numerical mandate of the HPRD requirement. Because the Court found that the Final Rule’s challenged provisions contravened Congress’s prescriptions under the Reform Law, it did not reach arbitrary and capricious analysis or the major questions doctrine arguments that Plaintiffs raised in their complaint. The Court then vacated that challenged provisions of the Final Rule.

As of April 10, 2025, this case remains open because the court’s order is within the window of appeal.
