This case challenged President Trump’s and the U.S. DOGE Service’s dismantling of the United States Institute of Peace (USIP), a congressionally chartered nonprofit organization created to promote global conflict resolution. On April 10, 2025, a group of former USIP employees, contractors, and a donor filed this lawsuit in the U.S. District Court for the District of Columbia. Plaintiffs filed an amended complaint on April 14. They named the U.S. DOGE Service, President Trump, the USIP, the General Services Administration (GSA), and several senior officials as defendants. 

The case was assigned to Judge Beryl A. Howell.

Represented by Emery Celli Brinckerhoff Abady Ward & Maazel and Ali & Lockwood LLP, the plaintiffs sought declaratory and injunctive relief under the Administrative Procedure Act (APA) and constitutional separation of powers doctrines. They alleged that the President and executive officials lacked legal authority to dismiss USIP’s board, terminate hundreds of employees and contracts, seize USIP's building, and publicly disclose information that endangered personnel abroad. They claimed these actions exceeded statutory authority, violated Congress’s intent to preserve USIP’s independence, and were arbitrary and capricious under the APA.

The plaintiffs also filed an emergency motion for a temporary restraining order (TRO) to halt the dismantling of USIP and reinstate employees. On April 22, Judge Howell held an emergency hearing. While expressing concern about the safety risks to overseas personnel, the court denied the TRO, finding the requested relief too broad at that early stage. The court instead ordered expedited discovery, including depositions of several high-level officials.

This case is related to U.S. Institute of Peace v. Jackson, also before Judge Howell, in which the official USIP board challenged its ouster. On May 19, the court granted summary judgment (SJ) for the board in Jackson, ruling that the President’s removal of USIP directors was unlawful and voided all acts by the replacement leadership. That ruling was appealed, and the D.C. Circuit granted the government’s motion to stay the Jackson judgment pending appeal.

On June 5, Judge Howell granted a joint motion to stay proceedings in Pippenger pending further developments in Jackson. The stay was automatically lifted on June 27 when the D.C. Circuit stayed the Jackson judgment, but both parties then jointly moved to reinstate and modify the stay. On July 7, the court approved a new stay structure. The stay will now remain in place until either (1) the D.C. Circuit denies en banc rehearing in Jackson or the Supreme Court grants a stay, or (2) the Jackson judgment is modified or vacated. The plaintiffs may also lift the stay at any time with two weeks’ notice.

If the stay is lifted, deadlines will resume on the pending discovery motion and the government’s response to the amended complaint. The court ordered the parties to file joint status reports every 60 days. The case remains ongoing.
