This case challenged the U.S. Department of Labor’s decision to terminate all international cooperative agreements administered by the Bureau of International Labor Affairs (ILAB). On April 15, 2025, represented by Public Citizen Litigation Group, three nonprofit organizations—the American Center for International Labor Solidarity (Solidarity Center), the American Institutes for Research (AIR), and the Global March Against Child Labour—filed this lawsuit in the U.S. District Court for the District of Columbia.

The case was assigned to Chief Judge Beryl A. Howell.

The plaintiffs had received over $100 million in federal funds through fifteen active ILAB cooperative agreements to operate international programs addressing labor rights, child labor, and forced labor. In March 2025, the Department of Labor, under Secretary Lori Chavez-DeRemer, abruptly terminated all ILAB agreements, citing “alignment with agency priorities and national interest.” Public statements by the Secretary and the Department's political leadership criticized the programs as “‘America Last’ foreign handouts,” and stated the administration would “reinvest” the unspent funds in domestic initiatives.

Plaintiffs claimed the mass termination was unlawful. They alleged that (1) the termination violated congressional mandates in appropriations laws and the USMCA Implementation Act, which required ILAB to fund specific categories of international labor programs; (2) the Department’s refusal to spend the appropriated funds violated the Impoundment Control Act; (3) the terminations created unlawful funding “reserves” in violation of the Anti-Deficiency Act; and (4) the Department’s actions were arbitrary and capricious under the Administrative Procedure Act (APA). They sought declaratory and injunctive relief reinstating the agreements and preventing further terminations.

On June 30, the court denied plaintiffs’ motion for partial summary judgment (SJ) (Counts I-IV), denied their motion for a preliminary injunction (PI) on Count V, and denied the government’s cross-motion for summary judgment. The court found that factual disputes remained regarding whether the Department had acted with the intent to disregard legislative directives or was merely reallocating funds consistent with new policy priorities. The court rejected the government’s argument that jurisdiction lay exclusively in the Court of Federal Claims, holding that plaintiffs’ claims sounded in constitutional and statutory violations rather than breach of contract.

The case remains ongoing.
