In this case the State of California challenged tariffs imposed by President Trump in February 2025, citing his authority under the International Economic Emergency Powers Act (IEEPA). The administration's policies included broad tariffs on almost all imported goods and increased tariffs targeting specific countries such as China, Canada, and Mexico.

On April 16, 2025, the State of California and Governor Gavin Newsom, represented by the State Attorney General, filed this lawsuit in the U.S. District Court for the Northern District of California. They sued President Trump, the Department of Homeland Security, and DHS's component agency, U.S. Customs and Border Protection. The plaintiffs argued that President Trump’s many executive orders imposing these tariffs (linked below under "Resources") exceeded the authority granted by the IEEPA and that the IEEPA was meant to limit presidential powers rather than extend them. Given the serious consequences of imposing tariffs, the plaintiffs insisted that Congress should have explicitly authorized the president to take such unilateral actions; without such explicit authorization, the plaintiffs argued that the executive orders violated the Constitution's separation of powers principles.

The plaintiffs requested a judgment declaring the tariff orders unlawful, an injunction against the implementation or enforcement of the orders, and court costs.

The case was assigned to District Judge Jacqueline Scott Corley. On April 17, 2025, the defendants filed a motion to transfer the case to the U.S. Court of International Trade (CIT), arguing that court has exclusive jurisdiction over trade matters. On May 13, the plaintiffs submitted a motion for a preliminary injunction, claiming that California would face irreparable harm if the tariffs stayed in effect. A hearing on the defendants' motion to transfer the case took place on May 27.

While the court was considering this case, on May 28, in V.O.S. Selections, Inc. v. Trump, the Court of International Trade held that the Trump tariffs were unlawful. On May 29, in Learning Resources, Inc. v. Trump, a district judge in the District of Columbia refused to transfer the case to the Court of International Trade and issued a preliminary injunction preventing enforcement of the tariffs. Both orders were stayed pending appellate review. 

On June 2, 2025, the court issued an order denying the defendants' motion to transfer the case and a judgment dismissing the case. The court found that the CIT had exclusive jurisdiction over a case if it "arises out of a United States law providing for tariffs." Here, the case arose out of a United States law (the Executive Order) creating tariffs, so the CIT has exclusive jurisdiction. However, the plaintiffs requested the court to dismiss, rather than transfer, the case, which the court did "to allow California to pursue a prompt appeal of the jurisdictional question" in the Ninth Circuit. 2025 WL 1569334. 

On June 2, the plaintiffs appealed to the Ninth Circuit and filed a motion to expedite the case on June 4. The Court of Appeals scheduled oral argument in the case for September 17.
