This case challenges President Trump’s imposition of tariffs under the International Emergency Economic Powers Act (IEEPA). On April 22, 2025, two educational toy manufacturers—Learning Resources, Inc. and hand2mind, Inc.—filed this lawsuit in the U.S. District Court for the District of Columbia against President Trump and key federal government officials from various departments. Represented by private counsel, the plaintiffs sought declaratory and injunctive relief, arguing that IEEPA does not authorize the President to impose import tariffs, and that doing so violates the constitutional principle of separation of powers.

The case was assigned to District Judge Rudolph Contreras.

The plaintiffs challenged multiple executive orders issued under IEEPA, which imposed tariffs on a wide range of imports, including products from China. They argued the President lacked statutory authority and that the implementing agencies violated the APA. On April 24, the defendants moved to transfer the case to the U.S. Court of International Trade (CIT), arguing it had exclusive jurisdiction over tariff-related challenges. The plaintiffs opposed this transfer, arguing that IEEPA itself does not explicitly provide for tariffs, and thus the case belongs in federal district court under general federal question jurisdiction. Plaintiffs simultaneously moved for a preliminary injunction.

On May 29, 2025, Judge Contreras denied the motion to transfer and granted the preliminary injunction, ruling that IEEPA does not authorize the President to unilaterally impose tariffs.  2025 WL 1525376. The government appealed, and sought a stay pending that appeal from both the district court and the court of appeals. It also sought expedited briefing in the court of appeals.

On June 3, 2025, the district court granted the government’s motion to further stay the injunction pending resolution of the appeal. The government then withdrew its parallel request for a stay from the D.C. Circuit as moot.

On June 17, 2025, pointing to the national need for speedy resolution of the issue, the plaintiffs filed a petition for writ of certiorari before judgment in the U.S. Supreme Court, seeking direct review of the district court’s decision, and sought expedited briefing on that petition. On June 18, 2025, the D.C. Circuit granted the government’s motion to expedite the appeal. On June 20, the Supreme Court denied the plaintiffs’ request for expedited scheduling on the cert. before judgment petition, allowing the government the standard 30 days to respond.

This case remains ongoing in both the D.C. Circuit and the U.S. Supreme Court.
