This is a case about the censorship of books and curricula in federally operated schools for military families. 

During the first weeks of his second term, President Trump issued a series of executive orders aimed at reshaping educational content in federally operated schools. On January 22, 2025, he signed Executive Order 14168, titled “Combating Gender Ideology in Federal Education,” which prohibited federally funded schools from including materials that “promote gender transition, nonbinary identities, or gender fluidity.” Two days later, on January 24, 2025, he issued Executive Order 14185, “Protecting American History and Civics,” which directed federal agencies to eliminate “divisive concepts” from all educational programs they administer. On January 29, 2025, he signed Executive Order 14190, “Promoting Patriotic Education in Military Communities,” which required the Department of Defense to revise school curricula to align with “patriotic values” and exclude content deemed to “undermine national unity.” Together, these executive orders prompted widespread removal and restriction of books and instructional materials in Department of Defense Education Activity (DoDEA) schools, particularly those addressing race, gender, and LGBTQ+ topics. They also resulted in the cancellation of longstanding school events, including Black History Month and Women’s History Month.

On April 15, 2025, several parents, on behalf of their minor children, filed this lawsuit in the United States District Court for the Eastern District of Virginia. The plaintiffs sued DoDEA, DoDEA Director Dr. Beth Schiavino-Narvaez, and Secretary of Defense Peter Hegseth in their official capacities. They challenged DoDEA’s removal and restriction of books and curricular content pursuant to Executive Orders 14168, 14185, and 14190. The case was assigned to Judge Patricia Tolliver Giles.

Represented by private counsel from the ACLU of Virginia, ACLU of Kentucky, and the ACLU’s national office, the plaintiffs sought declaratory and injunctive relief. They claimed that the government’s actions violated the First Amendment by engaging in viewpoint-based censorship and depriving students of their right to receive information. They also alleged that the removal of hundreds of books and instructional materials lacked any legitimate pedagogical basis.

On May 7, 2025, the plaintiffs moved for a preliminary injunction to prohibit enforcement of the executive orders and compel DoDEA to restore access to removed materials. A hearing was rescheduled to June 3, 2025, where Judge Giles took the motion under advisement and ordered the defendants to produce a list and copies of all removed materials within seven days.

The defendants filed a motion for reconsideration of the June 3, 2025, order on June 11, 2025, arguing that the list of books was privileged and could not be expanded into the factual record during the preliminary injunction phase. The court denied this motion, and on July 11, 2025, issued an order formally denying the defendants' motion for reconsideration, finding that the list was purely factual, had a real operative effect, and was critical evidence not protected by privilege. 2025 WL 1921928. The order included as "Attachment A" the list of the 596 books removed by DoDEA.

On June 27, 2025, the defendants filed a motion to dismiss, asserting that the plaintiffs lacked standing, the case presented nonjusticiable political questions, and the claims failed to state a constitutional violation because the government has broad discretion over educational content in federal schools. The motion also argued that no Bivens remedy should be extended to this context. A hearing on the motion to dismiss was scheduled for July 24, 2025, but was terminated on July 17, 2025.

The case remains ongoing.
