This is a case about whether Iowa could create its own state system for arresting, prosecuting, and effectively expelling certain noncitizens even though Congress had already occupied that field. On May 9, 2024, Iowa Migrant Movement for Justice, along with two pseudonymous lawful permanent residents, filed suit in the United States District Court for the Southern District of Iowa, Central Division. The case was assigned to Judge Stephen H. Locher. The plaintiffs sued as an immigrant-rights organization and individual residents who said the new law put them at immediate risk. They sued Iowa Attorney General Brenna Bird, Polk County Attorney Kimberly Graham, and Clayton County Attorney Zach Herrmann in their official capacities. Represented by ACLU and the American Immigration Council, they sought declaratory relief, a preliminary and permanent injunction, attorneys’ fees, and costs. They claimed that Iowa Senate File 2340 was preempted by federal immigration law under the Supremacy Clause and also violated the Commerce Clause because it tried to create a separate state immigration regime.

The complaint described S.F. 2340 as a law that would make it a state crime for some noncitizens to be present in Iowa after a prior removal-related event, would let state judges order people to “return” to another country, and would provide no state-law defense for people who had later reentered with federal permission or gained lawful status. The plaintiffs said that design collided with the federal immigration system, which already controlled admission, removal, discretionary enforcement, and humanitarian protections such as asylum and protection against return to torture. One day after filing suit, on May 10, 2024, the plaintiffs moved for a preliminary injunction. The district court then handled the injunction request alongside a companion federal enforcement suit brought by the United States against Iowa over the same statute, United States v. Iowa. A hearing was held on June 10, 2024.

On June 17, 2024, Judge Locher granted a preliminary injunction and barred enforcement of S.F. 2340 pending further proceedings. In the published ruling, the court concluded that the plaintiffs had standing and were likely to succeed because federal law likely preempted the Iowa statute in full. The court treated the harms as immediate and serious because the law threatened arrest, prosecution, forced departure orders, and interference with the federal government’s control over immigration and foreign relations. 737 F. Supp. 3d 725. Iowa appealed on June 19, 2024, and the district court stayed further district-court proceedings on August 29, 2024 while the appeal moved forward. 

In January 2025, the Eighth Circuit briefly issued an order that would have vacated the district court’s injunction and directed dismissal. However, on April 16, 2025, the panel granted rehearing and vacated its own January disposition. After supplemental briefing, the Eighth Circuit issued a new merits opinion on October 23, 2025 that kept the preliminary injunction in place but sent the scope question back for further consideration. 157 F.4th 904. The Eighth Circuit held that the district court was right to keep Iowa’s Senate File 2340 blocked because the plaintiffs were likely to win their claim that the law conflicted with federal immigration law. On the merits, the court said Iowa’s law likely failed across the board because it created a parallel state immigration-enforcement system. The Court turned to S.F. 2340, explaining that section 2 imposed state criminal penalties for reentry-related conduct despite federal exceptions and federal enforcement discretion, section 4 required state judges to order individuals to “return” to another country in intrusion on the federal government’s exclusive authority over removal decisions and destination choices, and section 6 barred state courts from staying prosecutions while federal immigration proceedings were pending, further undermining federal control. The court also rejected Iowa’s arguments that the statute should be read narrowly or saved by Iowa’s later 287(g) agreement with ICE, emphasizing that federal immigration enforcement must remain under federal supervision and with “one national sovereign,” not fifty separate state systems. Because the plaintiffs also showed likely irreparable harm and the balance of harms and public interest favored an injunction, the Eighth Circuit affirmed the preliminary injunction.

Defendants’ request for rehearing was denied in February 2026, and the mandate reached the district court on February 18, 2026. 

As of April 13, 2026, the case remains ongoing.
