In early April 2025, the Trump Administration abruptly terminated thousands of international students’ F-1 visas and records with the Student and Exchange Visitor Information (SEVIS), threatening them with deportation. The plaintiffs in this case and as many as a hundred others alleged that the administration's actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting. The lawsuits alleged that Defendants’ actions violated the Administrative Procedure Act and the Fifth Amendment.  On April 25, 2025, the administration reversed course; more details to follow. 

This case in particular was filed on April 14, 2025, in the U.S. District Court for the Western District of Michigan, by international students attending school on F-1 visas. They sued the Secretary of the U.S. Department of Homeland Security (DHS), the Acting Director of Immigration and Customs Enforcement (ICE), and the Detroit field director of ICE, all in their official capacities. The case was assigned to District Judge Jane Beckering.

On April 24, 2025, Judge Beckering granted a temporary restraining order, holding that the legality of the government's conduct was questionable under the Administrative Procedure Act, because the steps taken seemed not to reflect the relevant regulations. Accordingly, the court ordered DHS to "set aside the F-1 student record termination decisions as to Plaintiffs" and "restore each Plaintiff’s F-1 student record in the Student and Exchange Visitor Information System (SEVIS), retroactive to the date of termination," and the court barred related continuing adverse conduct, including:

  • re-terminating the SEVIS record,
  • revoking Optional Practical Training employment authorizations;
  • "arresting, detaining, or transferring Plaintiffs out of the current jurisdiction in which they are located, or ordering the arrest, detention, or transfer of Plaintiffs out of the jurisdiction where they are currently located, without first providing adequate notice to both this Court and Plaintiffs’ counsel as well as time to contest any such action", or
  • "initiating removal proceedings against or deporting any Plaintiff on the basis of the termination of their F-1 student record in SEVIS."

On April 25, 2025, ICE announced it would reactivate the records of terminated students, and develop a policy addressing SEVIS termination.

Plaintiffs argued that the imminent prospect of a new SEVIS termination policy justified a preliminary injunction. On May 7, 2025, Judge Beckering granted plaintiffs' request for a preliminary injunction, finding that plaintiffs were at substantial risk of harm from defendants' deletion and possible re-termination of their SEVIS records and that plaintiffs were likely to succeed on the merits of their claims given the torrent of rulings in other district courts nationwide against defendants' attempts to wipe immigration records.

The case is ongoing.
