Plaintiffs, the President's Alliance on Higher Education and Immigration and five international students attending colleges and universities located in Massachusetts on an F-1 visa, filed this lawsuit in the U.S. District Court for the District of Massachusetts against the Secretary of Homeland Security and the Acting Director of Immigration and Customs Enforcement (ICE) on April 24, 2025. In early April, the defendants abruptly terminated the plaintiffs’ F-1 visas and Student and Exchange Visitor Information System (SEVIS) records, effectively stripping them of their ability to remain students in the United States. These revocations were part of a mass-termination, in which the defendants voided thousands of international students’ SEVIS records following highly publicized arrests of students who had engaged in political protest or expressed views that the government disliked. The plaintiffs argued that these terminations were based on improper reasons such as minor legal issues, often without notice or explanation, leaving students unable to continue their studies, work, or remain in the United States. The plaintiffs contended that the policy guiding the terminations violated the Administrative Procedure Act and the Fifth Amendment by being unlawful, arbitrary, and procedurally unfair, and sought a court order enjoining the policy and restoring the students’ legal status.

This case was assigned to District Court Judge Patti Saris

The same day they filed their complaint, the student plaintiffs filed a motion requesting to proceed under fictitious names in their complaint and all other filings in order to maintain and protect their safety, privacy, and reputational interests as they seek redress. The court granted the order on April 28.

On June 27, 2025, four of the students filed a notice of voluntary dismissal of their claims. 

The same day, the plaintiffs filed an amended complaint, which omitted the four students who dismissed their claims as complaints, added new defendants, and added new legal claims and factual developments. First, the amended complaint added the Department of State (DOS) and Secretary of State Marco Rubio as defendants. Next, the amended complaint retained only one student who did not dismiss their claim and added the Association of Independent Colleges and Universities in Massachusetts (AICUM) as plaintiffs. The amended complaint also developed the factual record, explaining that the mass terminations of student visas were a result of an effort internally referred to as the “Student Criminal Alien Initiative” (SCAI), whereby ICE employees ran the names of 1.3 million international students in the United States through the National Crime Information Center (NCIC) database, and revoked the visas of many, if not all, of the students who appeared in the search. The new complaint further alleged that after the terminations, the DOS sent communications to students misrepresenting the consequences of their visa cancellations, in an effort to intimidate these students into self deporting. Finally, the amended complaint added two new APA claims, arguing that the government failed to follow notice-and-comment rulemaking for these new ICE policies, and that the letters sent to students following their visa revocations constituted an arbitrary and capricious “Intimidation Policy”.

 On August 4, 2025, the remaining student plaintiff voluntarily dismissed their claim.
Then, on August 15, 2025, the defendants filed a motion to dismiss this action for lack of jurisdiction and for failure to state a claim. The court held a hearing on the motion to dismiss on December 9, 2025. 

The court partially denied the government’s motion to dismiss on March 20, 2026, allowing the majority of the lawsuit challenging the SCAI to proceed. The court found that claims regarding SEVIS terminations are not moot under the voluntary cessation doctrine, as the government failed to prove that the challenged behavior could not reasonably be expected to recur. While the court upheld the challengeability of the visa revocation policy and SEVIS termination policy as final agency actions, it dismissed the plaintiffs’ claims regarding the "Intimidation Policy," concluding that the letters sent to students did not constitute final agency action since they merely informed students of prior decisions without determining new rights. 2026 WL 788185.
