On April 29, 2025, the Corporation for Public Broadcasting (CPB), its board, and three individual board members filed this lawsuit in the United States District Court for the District of Columbia against President Donald Trump, the U.S. Office of Management and Budget and its Director, the White House Presidential Personnel Office and its Director, and the Deputy Director of Presidential Personnel for the Executive Office of the President of the United States. They challenged Defendants' purported termination of Plaintiffs' positions on the CPB board, arguing that as a Congressionally-created private corporation, the President lacked removal power over CPB. They alleged that their purported termination violated the Administrative Procedure Act, separation of powers, and the Presentment, Appropriations, and Take Care Clauses.

The case was assigned to Judge Randolph D. Moss the day it was filed, and Plaintiffs moved for a temporary restraining order (TRO) the same day. By agreement of the parties, the court considered Plaintiffs' motion for a TRO as a motion for a preliminary injunction.

On June 8, 2025, while noting that the merits of the case were not yet before the court, the court denied Plaintiffs a preliminary injunction.  The court held that Plaintiffs did not adequately demonstrate they were likely to succeed on the merits, because Congress likely intended for the President to exert a degree of control over CPB. The court additionally concluded that Plaintiffs could not prove they faced a risk of irreparable harm, because their replacements would have to be nominated and Senate-confirmed, a lengthy process likely to take longer than a final verdict in this case.

The court denied the requested injunction without prejudice, allowing Plaintiffs to renew their motion if Defendants or their affiliates "take steps to interfere" with CPB's independence. This case is ongoing.
