This case is about a challenge to Colorado and Denver laws that the U.S. Department of Justice (DOJ) refers to as “sanctuary laws” and that they claim obstruct federal immigration enforcement. On May 2, 2025, the DOJ filed this lawsuit in the U.S. District Court for the District of Colorado against the State of Colorado, its Governor, its Attorney General, and several other state and local officials. The DOJ alleged that the challenged laws impermissibly interfered with federal immigration enforcement in violation of the Supremacy Clause, as well as 8 U.S.C. § 1373. The case was initially assigned to Magistrate Judge Kathryn A. Starnella. However, on May 27, 2025, it was randomly reassigned to District Judge Gordon P. Gallagher.

At the state level, the DOJ challenged three statutes. First, it challenged House Bill 19-1124, which barred Colorado law enforcement from arresting or detaining individuals based solely on civil immigration detainers and imposed procedural requirements for federal immigration interviews. Second, the DOJ challenged Senate Bill 21-131, which restricted the sharing of personal identifying information with federal immigration authorities and limited inquiries into a person’s immigration status. Third, the DOJ challenged House Bill 23-1100, which prohibited state and local governments from entering into or renewing immigration detention agreements. The DOJ claimed reduced available detention capacity and increased the burden of transporting detainees.

At the local level, the DOJ challenged two measures adopted by the City and County of Denver. Specifically, it challenged Denver Ordinance No. 940-17, known as the Public Safety Enforcement Priorities Act. The ordinance barred the use of city resources to support federal immigration enforcement and restricted both information sharing and access to secure jail facilities. In addition, the DOJ contested Executive Order No. 142, issued by the Mayor of Denver in 2017, which declared Denver a “safe and welcoming city for all” and reaffirmed the city’s limits on cooperation with federal immigration authorities.

The DOJ alleged that these laws were preempted by federal statutes, specifically 8 U.S.C. sections 1373(a) and 1644, and amounted to unlawful discrimination against and regulation of the federal government. Represented by government counsel, the DOJ sought a judgment declaring several Colorado and Denver “sanctuary laws” invalid, preliminary and permanent injunctions to prohibit their enforcement, and the recovery of costs and fees.

This case is ongoing.
