This case raised a challenge to discontinuation of grants under the federal Equity Assistance Center (EAC) Program. On May 8, 2025, Mid-Atlantic Equity Consortium (MAEC) and the NAACP filed this lawsuit in the United States District Court for the District of Columbia against the U.S. Department of Education (ED) and its Secretary. Plaintiffs challenged ED's termination of EAC grants awarded to MAEC and other grant recipients to promote equity in education, effectively ending the EAC program authorized by Congress. Since 1964, the EAC program has provided assistance to schools in meeting their nondiscrimination obligations under the Civil Rights Act. Plaintiffs alleged that ED's termination of EAC grants violated the Fifth Amendment, the First Amendment, the Separation of Powers, and the Administrative Procedure Act, and abrogate obligations under the Civil Rights Act of 1964. Plaintiff sought declaratory and injunctive relief. The case was assigned to District Judge Paul L. Friedman.

On May 22, 2025, plaintiffs filed a motion for a Preliminary Injunction (PI). The court granted in part and denied in part a preliminary injunction against defendants on July 30, 2025. The injunction required ED to reinstate MAEC's grant and reimburse MAEC's reasonable expenditures and expenses incurred following the grant's termination. ED was also forbidden from terminating the grant award program at issue.

The injunction finally required a status report from the parties within ten business days of its order. 

The plaintiffs filed an amended complaint on July 7th.

On October 29, 2025, plaintiffs filed a status report informing the court that, in according with the preliminary injunction order, "Defendants reinstated MAEC’s EAC Region I Grant Award (S004D220002) in accordance with the Grant Award Notification terms and conditions in place immediately prior to the Department’s issuance of the February 13, 2025 Termination Letter."

In light of the government shutdown, on October 29, the court ordered the parties to file a joint status report within 21 days after the lapse in federal funding concludes and the government re-opens.

In their December 4, 2025, status report, the parties indicated that they have been negotiating the terms of a consent decree to resolve this matter. They agreed to submit a further status report (if necessary) by February 2, 2026, to provide the court with an update on their efforts to resolve the matter.

This case is ongoing.
