This case raises a challenge to discontinuation of grants under the federal Equity Assistance Center (EAC) Program. On May 8, 20225, Mid-Atlantic Equity Consortium (MAEC) and the National Association for the Advancement of Colored People filed this lawsuit in the United States District Court for the District of Columbia against the U.S. Department of Education and its Secretary. The Plaintiffs challenged the department's termination of EAC grants awarded to MAEC and other grant recipients to promote equity in education, effectively ending the EAC program authorized by Congress. Since 1964, the EAC program has provided assistance to schools in meeting their nondiscrimination obligations under the Civil Right Act. The Plaintiffs alleged that the department's termination of EAC grants violated the Fifth Amendment, the First Amendment, the Separation of Powers, and the Administrative Procedure Act, and abrogate obligations under the Civil Rights Act of 1964. The case was assigned to District Judge Paul L. Friedman.
