On April 17, 2025, an international student—attending school on an F-1 visa--filed this lawsuit in the United States District Court for the District of South Dakota against the Secretary of Homeland Security and the Acting Director of Immigration and Customs Enforcement. In early April, the Defendants abruptly terminated the Plaintiff’s, and other international students’, F-1 visa and records with the Student and Exchange Visitor Information (SEVIS), effectively stripping them of their ability to remain a student in the United States. The Plaintiff alleged that Defendants' actions were unlawful and designed to coerce them and other international students into abandoning their studies and self-deporting. The Plaintiff alleged that Defendants’ actions violated the Administrative Procedure Act and the Fifth Amendment, in that her minor traffic misdemeanor conviction was not a lawful basis for invalidating her student visa status. The case was assigned to District Judge Karen E. Schreier.

On April 18, Judge Schrier issued a temporary restraining order, reinstating plaintiff's SEVIS record and granting other relief. 2025 WL 1149498. Following additional briefing, in which the government claimed that by reinstating the record it had mooted the case, on May 15 Judge Schrier issued a preliminary injunction. 2025 WL 1413266. Finding a likelihood of success on the merits of the plaintiff's claim that termination of her record violated the relevant immigration law, the court ordered that the SEVIS record be retroactively reinstated and no further enforcement action be taken during the pendency of the litigation. Plaintiffs immediately, also on May 15, moved that the court convert the preliminary injunction into a permanent injunction.

The following month, on June 30, Defendants filed a motion to dismiss for failure to state a claim and for lack of jurisdiction. Weeks later, on July 14, Defendants filed a notice of interlocutory appeal regarding the preliminary injunction. However, Defendant-Appellants moved to voluntarily dismiss the appeal on October 24 pursuant to Federal Rule of Appellate Procedure 42(b). Their motion was granted on October 31, and the case continued to progress through the district court.

On January 12, 2026, the court denied Plaintiff's motion for permanent injunction without prejudice, while granting in part and denying in part Defendants' motion to dismiss. The court refused to recognize the case as moot, despite Defendant's argument that Plaintiff's SEVIS record was reinstated, as Defendants had failed to explain why re-termination of Saxena’s SEVIS record could not be reasonably expected to occur. It did, however, amend the scope of its previous preliminary injunction to encompass only action based on the April 4, 2025, termination of Plaintiff's SEVIS record.
