On May 9, 2025, a noncitizen detained in ICE holding cells operated by the Baltimore Field Office filed this putative class action lawsuit in the U.S. District Court for the District of Maryland. The plaintiff sued the Director of the Baltimore Field Office of ICE, other ICE officials in their official capacities, the Secretary of Homeland Security, and the Attorney General, asserting claims under the Administrative Procedure Act (APA), 5 U.S.C. § 706, and the Due Process Clause of the Fifth Amendment. Represented by the Amica Center for Immigrant Rights, the National Immigration Project, and Crowell & Moring LLP (pro bono), the plaintiff alleged that the defendants subjected detainees to overcrowded cells and denied them adequate food, water, sleep, hygiene supplies, medical care, and access to counsel, while unlawfully waiving ICE's own twelve-hour detention limit. The plaintiff sought declaratory and injunctive relief to remedy the allegedly inhumane conditions and compel adequate food, water, hygiene, medical care, sleeping conditions, and access to counsel at the Baltimore Hold Rooms, a writ of habeas corpus, and attorneys' fees under the Equal Access to Justice Act. Chief Judge Richard D. Bennett assigned the case to District Judge Julie Rebecca Rubin.

The complaint alleged that in January 2025, the Director of the Baltimore Field Office of ICE obtained a waiver of ICE Directive 11087.2's twelve-hour hold room limit, initially extending it to sixty hours, in response to the administration's increased enforcement posture following Executive Orders issued on January 20, 2025. The Baltimore Hold Rooms had a maximum capacity of 56 people across five cells, but the complaint alleged the defendants routinely detained far more people for multiple days. Detainees were allegedly forced to sleep on concrete floors with lights on, had no access to soap, showers, toothbrushes, or clean clothes, received only three small bottles of water daily, and were provided military-style rations in place of meals.

The complaint was originally filed under case number 1:25-cv-01500-JRR. On May 12, 2025, the plaintiff filed a first amended complaint adding a second plaintiff. On May 14, following an emergency hearing, the court granted injunctive relief pursuant to the All Writs Act, 28 U.S.C. § 1651(a), enjoining the plaintiff's removal from the continental United States. On May 20, the court administratively closed that docket and re-docketed the case as a non-habeas civil action under number 1:25-cv-01613-JRR.

On June 6, 2025, the Plaintiffs moved for class certification, and on June 12, they moved for a preliminary injunction. The State of Maryland filed an amicus brief in support on June 18. On July 11, the court granted leave to file a second amended complaint, which added defendants, factual allegations, and individual habeas claims, and defined the proposed class as all persons now or in the future detained at the Baltimore Hold Rooms. The operative complaint asserted eleven counts, including APA claims for the unlawful waiver of ICE policy and multiple Fifth Amendment due process claims for deprivation of sleep, hygienic conditions, medical care, food and water, and access to counsel.

On July 23, 2025, District Judge Julie Rebecca Rubin granted in part the Plaintiffs' motion to proceed under pseudonyms, allowing the named plaintiffs to use initials but declining to extend the protection to all putative class members. 2025 WL 2062184.

On July 25, 2025, District Judge Julie Rebecca Rubin denied class certification without prejudice. 2025 WL 2098633. The court found that the named plaintiffs had not demonstrated sufficient involvement in the litigation to satisfy adequacy, and that the breadth of conditions-related claims defeated commonality. Because the named plaintiffs had been transferred out of the Baltimore Hold Rooms and class certification was denied, the court also denied the preliminary injunction as moot and without prejudice. The court subsequently ordered expedited discovery in advance of a renewed motion.

On September 9, 2025, the Government moved to dismiss the second amended complaint. On September 17, after a hearing, District Judge Julie Rebecca Rubin denied the Plaintiffs' motion for expedited bail hearings. On October 20, the parties stipulated to dismiss Counts VIII through XI (individual habeas claims asserted only on behalf of the named plaintiffs) without prejudice.

On December 9, 2025, District Judge Julie Rebecca Rubin granted in part and denied in part the motion to dismiss. The court again rejected the Government's mootness argument, reaffirming the inherently transitory class-action relation-back exception. On the merits, the court dismissed Count II, the Accardi-based substantive due process claim, holding that controlling law did not support the Accardi doctrine as a vehicle for a substantive due process claim, but ruled that the Plaintiffs could still rely on Accardi in support of their APA claim (Count I). Six counts survived: Count I (APA, waiver of policy), Count III (due process, sleep), Count IV (due process, hygienic and sanitary conditions), Count V (due process, medical care), Count VI (due process, food and water), and Count VII (due process and INA, access to counsel).

On December 23, 2025, the Plaintiffs filed a renewed motion for class certification and preliminary injunction supported by extensive additional declarations and discovery materials. After briefing and an evidentiary hearing on March 3, 2026, District Judge Julie Rebecca Rubin issued a memorandum opinion on March 6 granting the motion. The court certified a Rule 23(b)(2) class defined as "All persons who are now, or will be, detained at the Baltimore Hold Rooms," designated two named plaintiffs as class representatives, and appointed the Amica Center, the National Immigration Project, and Crowell & Moring LLP as class counsel. This case is now a certified class action. The court rejected the Government's mootness challenge for a fourth time and, on the merits, found the Plaintiffs demonstrated a likelihood of success on their Fifth Amendment conditions-of-confinement claims (Counts IV and V), concluding that the Defendants deprived detainees of hygienic, sanitary, and safe conditions, as well as basic medical screening and care. The court found the injunction was prohibitory, as it sought to restore the pre-waiver status quo of February 2025, and that irreparable harm, balance of equities, and public interest all favored relief.

The preliminary injunction ordered that each detained individual must have personal space of no less than 31 square feet (exclusive of area within eight feet of any toilet), that hold rooms be cleaned thoroughly at least once daily, and that each detained individual receive adequate daily supplies of soap, towels, toilet paper, oral hygiene items, and feminine hygiene products. The order required a basic medical screening within twelve hours of entry, prompt access to over-the-counter pain medication, access to prescription medications within 24 hours, and prompt access to emergency medical care. The order required the Defendants to provide written notice in English and Spanish within one hour of arrival informing detained individuals of their rights, and to adopt written compliance procedures within 60 days. The court also granted the Plaintiffs' motion to "proceed under pseudonym" for additional class members.

On May 5, 2026, the Defendants filed a notice of appeal to the U.S. Court of Appeals for the Fourth Circuit (No. 26-6580). As of June 2026, the case remained ongoing, with discovery proceeding in the district court under a scheduling order requiring a status report by October 23, 2026, and the appeal pending before the Fourth Circuit.
