This lawsuit challenged President Trump’s removal of Shira Perlmutter as Register of Copyrights and Director of the U.S. Copyright Office and the installation of Deputy Attorney General Todd Blanche as acting Librarian of Congress. On May 22, 2025, Shira Perlmutter filed suit in the U.S. District Court for the District of Columbia against Todd Blanche, Paul Perkins (purported acting Register), Sergio Gor (Director, White House Presidential Personnel Office), Trent Morse (Deputy Director, White House Presidential Personnel Office), the Executive Office of the President, and President Donald J. Trump. Perlmutter was represented by Democracy Forward Foundation and Munger, Tolles & Olson LLP. The case was assigned to Judge Timothy J. Kelly.

On May 8, 2025, President Trump removed Librarian of Congress Carla Hayden and subsequently appointed Blanche—then-Deputy Attorney General—to act as Librarian, invoking the Federal Vacancies Reform Act (FVRA) and Article II of the Constitution. Two days later, Blanche purported to remove plaintiff from her position as Register of Copyrights, immediately installing Paul Perkins as acting Register. Plaintiff alleged that President Trump lacked statutory and constitutional authority to remove Hayden, appoint Blanche as acting Librarian, or remove plaintiff. Specifically, she argued the FVRA does not authorize the President to appoint acting officials in legislative entities such as the Library of Congress, and that the President’s actions violated the Appointments Clause and separation-of-powers principles. She emphasized that, under federal law, only the Librarian could remove or appoint the Register of Copyrights, and Blanche did not have this power as President Trump could not lawfully appoint him to that position.

In response, the plaintiff sought a temporary restraining order (TRO) to prevent her removal and to reinstate her as Register. Following a hearing on May 28, Judge Kelly denied the TRO, finding that plaintiff had failed to demonstrate irreparable harm. The court held that her loss of a "statutory right to function" and any alleged institutional harm to the Library and Copyright Office did not meet the high threshold for irreparable harm under controlling D.C. Circuit precedent.

Following the denial of the TRO, the plaintiff moved for a preliminary injunction (PI), reiterating claims of irreparable institutional harm and injury to her statutory role. Defendants opposed the motion, arguing that the Library is an "Executive agency" under the FVRA, thus subject to presidential authority, and that Blanche’s appointment and plaintiff’s removal were lawful. Alternatively, defendants contended that the President possessed inherent constitutional authority to designate an acting Librarian and remove plaintiff directly.

On July 30, 2025, Judge Kelly denied the motion for a preliminary injunction, ruling that plaintiff again failed to demonstrate irreparable harm. The court reasoned that temporary deprivation of her role, absent a "genuinely extraordinary situation," did not justify emergency injunctive relief. The court found no compelling evidence that plaintiff could not be adequately reinstated at a later date, nor any indication that the Copyright Office would suffer permanent institutional harm without her immediate reinstatement.

The next day, plaintiff then filed a notice of appeal to the U.S. Court of Appeals for the D.C. Circuit, challenging the district court’s order denying her preliminary injunction. The plaintiff immediately moved for an emergency injunction pending appeal, which the district court denied on August 20, 2025. The court reasoned that she had again failed to show that she would be irreparably harmed absent relief.

In the D.C. Circuit, plaintiff moved for a separate emergency motion for an injunction pending appeal on DATE.. On September 10, 2025, the appellate court granted the motion, enjoining the government from interfering with the plaintiff's service as Register of Copyrights and Director of the U.S. Copyright Office pending further order of the court. 2025 WL 2627965. It held that the district court erred in its irreparable harm analysis by failing to consider “unusual actions relating to the discharge itself” and a “genuinely extraordinary situation." It explained that certain factors informed the irreparable-harm analysis and distinguished this case from other removal cases. The court listed the “unusual” and “extraordinary” aspects of this case:

The plaintiff alleged that the President removed her, an official in the Legislative Branch, based on his disagreement with the advice the plaintiff provided to Congress.
The President's removal of the plaintiff was likely unlawful.
The plaintiff did not seem to have exercised substantial executive power, which would distinguish this case from most of the precedents addressing the removal of government officials.

Following the decision, the defendants moved for a rehearing en banc, which the appellate court denied on October 1, 2025. On October 27, the government moved for the U.S. Supreme Court to stay the preliminary injunction. On a 2-1 vote on November 26, Chief Justice Roberts deferred the stay application pending the resolution of Trump v. Slaughter, No. 25-332, and Trump v. Cook, No. 25A312.

Meanwhile, back in the district court, plaintiff filed a motion for summary judgment on September 8, 2025. The government filed a cross-motion for summary judgment on September 22.

Following the decisions in Trump v. Slaughter and Trump v. Cook, the Supreme Court denied the government’s application for a stay on June 30, 2026. In the district court on July 31, both parties filed supplemental briefs on the effect of the two Supreme Court decisions. The D.C. Circuit Court also established a briefing schedule set to conclude on October 30, 2026.
