Case Summary

This is a challenge to DOGE-led efforts to centralize states' data on the Supplemental Nutrition Assistance Program (SNAP). On March 20, 2025, President Trump signed Executive Order 14243, titled "Stopping Waste, Fraud, and Abuse by Eliminating Information Silos," calling on agencies to "ensure unfettered access to comprehensive data from all state programs." USDA published a letter to SNAP State Agency Directors on May 6, telling them that USDA must retain unfettered access to their comprehens…

This is a challenge to DOGE-led efforts to centralize states' data on the Supplemental Nutrition Assistance Program (SNAP). USDA published a letter to SNAP State Agency Directors on May 6, telling them that USDA must retain unfettered access to their comprehensive data under the EO. 

On May 22, 2025, Plaintiffs--a nonprofit dedicated to fighting hunger, a public interest research center dedicated to securing the right to privacy in the digital age, and four individual Plaintiffs enrolled in SNAP--filed this lawsuit in the United States District Court for the District of Columbia against the U.S. Department of Agriculture and its Secretary and the Food and Nutrition Service and its Administrator. They brought this lawsuit to prevent Defendants from handing over collected personal data to DOGE, alleging that such a disclosure would violate the Administrative Procedure Act, the Privacy Act, and the Paperwork Reduction Act. The plaintiffs asked the court to declare that the USDA's actions were unlawful and arbitrary and capricious, to enjoin the defendants from collecting the information, and to order the disgorgement and destruction of any received information. 

The case was assigned to District Judge Jia M. Cobb. The plaintiffs filed an emergency motion for a temporary restraining order on May 27, seeking to prevent the defendants from harvesting any data collected by the state administrations. However, in response, the government indicated that no data was being transferred until the publication of a system of records notice and other steps. In light of the representations of the lack of imminent action, plaintiffs withdrew their motion for preliminary relief.

The case is ongoing.
