When the plaintiff attempted to enter the United States on February 16, 2025, the federal government detained her at Boston Logan Airport and revoked her J-1 visa for the alleged "smuggling" of frog embryos. Following the cancellation, she was deemed inadmissible and detained in Louisiana. On February 23, 2025, the plaintiff filed this petition for writ of habeas corpus in the U.S. District Court for the District of Vermont. The plaintiff sued the U.S. Department of Homeland Security (DHS), U.S. Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection (CBP), and various federal officials under 28 U.S.C. § 2241, the Fifth Amendment, and the Administrative Procedure Act. Although she pursued habeas corpus relief to challenge her detention, the U.S. government subsequently filed federal smuggling charges against her under 18 U.S.C. § 545, a statute that carries penalties of up to 20 years in prison, five years of supervised release, and a $250,000 fine. Judge Christina Reiss presides over the case.

Represented by private counsel, the plaintiff sought injunctive relief to end her detention, restoration of her visa or immigration status, and enjoinment of the criminal prosecution. The plaintiff also asserted a petition for a writ of habeas corpus, a request for declaratory relief asserting that her visa revocation and continued detention were unconstitutional. She argued that the government revoked her visa without notice or an opportunity to respond, that her continued detention lacked legal justification, and that the criminal charges against her were arbitrary, capricious, and in excess of statutory authority.

On May 28, 2025, Judge Christina Reiss ordered that the plaintiff be released from ICE immigration custody, finding that her detention was unlawful, she posed no danger or flight risk, and the frog embryo samples were non-living and non-hazardous. She remains in custody in Louisiana pending a bail hearing on criminal smuggling charges.

On May 30, 2025, the plaintiff filed an amended complaint. The amended complaint reiterated the plaintiff’s claims challenging her detention, visa revocation, and related government actions.

Then, on June 16, 2025, Judge Reiss issued an order granting in part and denying in part the plaintiff’s habeas petition. The court upheld its prior ruling that her immigration detention was unlawful and ordered her release from ICE custody. However, it denied the rest of the petition, including requests to overturn her visa revocation, stop the criminal prosecution, and obtain broader declaratory relief. The court found these claims were either beyond habeas jurisdiction or lacked legal and factual support. Specifically, it held that under 28 U.S.C. § 2241, it could not enjoin an ongoing criminal prosecution or reverse the visa revocation, and rejected the constitutional claims as unsubstantiated. Consequently, while the petitioner is no longer in immigration custody, she remains detained on federal smuggling charges. 

Following the June 16 order, on June 27, 2025, the defendants filed a motion to dismiss the amended complaint, challenging the court’s jurisdiction over certain claims and seeking dismissal of those beyond the court’s authority. The case remains ongoing, with no notice of appeal or final dismissal yet filed.

ORDER setting a hearing on June 9, 2025 at 3:00 p.m. regarding Petitioner Jane Doe's Petition for Writ of Habeas Corpus and Complaint for Declaratory and Injunctive Relief. (Doc. 1.) On March 3, 2025, the court issued an Order to Show Cause directing Respondents to show cause as to "why a writ of habeas corpus should not be granted to determine whether Ms. Doe 'was ordered removed under [8 U.S.C. § 1225(b)(1).]'" (Doc. 17) (quoting 8 U.S.C. § 1252(e)(2)(B)). In doing so, the court noted Ms. Doe's contention that neither she nor her counsel had been provided with a completed and signed Order of Removal. The Respondents' March 17, 2025 response to the Order to Show Cause argues that this case is now moot, but did not address the court's question of whether Ms. Doe was ordered removed and, if so, whether it provided a copy of the removal order to opposing counsel. (Doc. 24.) Opposing counsel represents that no complete Order of Removal has been produced. (Doc. 25.) Accordingly, the court sets the matter for an evidentiary hearing. Although Ms. Doe has been transferred to the Richwood Correctional Center in Richwood, Louisiana since filing her petition, this court retains jurisdiction pursuant to Ex parte Endo, 323 U.S. 283, 306 (1944); see also Rumsfeld v.
