This case is a challenge to a federal Geographic Targeting Order (GTO) that imposes significantly more stringent cash transaction reporting requirements on money services businesses (MSBs) operating in certain southern border ZIP codes. On May 30, 2025, two Texas-based businesses filed this lawsuit in the United States District Court for the Western District of Texas. The plaintiffs sued the Financial Crimes Enforcement Network (FinCEN) and its director, the U.S. Department of the Treasury and its secretary, and the U.S. Attorney General. The plaintiffs challenged the March 11, 2025, GTO, which required all MSBs located within thirty specified ZIP codes near the southern border to report any cash transactions exceeding $200. In comparison, in other areas, the standard reporting threshold was $10,000. District Judge Leon Schydlower presides over the case. 

Represented by the Institute for Justice, the plaintiffs sought injunctive relief to prevent enforcement of the GTO and declaratory relief declaring the order unlawful. The plaintiffs argued that the GTO’s requirements would cause severe financial harm to their businesses. They claimed that the order violated the Fourth Amendment protection against unreasonable searches and seizures, the Non-Delegation Doctrine limiting agency authority, the Fifth Amendment’s due process guarantees, and the Administrative Procedure Act’s procedural rules.

Also on May 30, 2025, the plaintiffs filed a motion for a temporary restraining order, followed shortly thereafter by a motion for a preliminary injunction. The court held a hearing on the plaintiffs’ motion for a preliminary injunction on June 11. On June 24, Judge Schydlower granted the TRO, temporarily blocking FinCEN and its agents from enforcing the GTO within the Western District of Texas while the court considers the plaintiffs’ motion for a preliminary injunction. The court found that the plaintiffs demonstrated a substantial likelihood of success on the merits, irreparable harm, and that the balance of equities and the public interest weighed in favor of granting relief. The TRO preserves the status quo pending a full ruling on the preliminary injunction.

The case is ongoing.
